Probate: On 10 October 1794, Samuel Eccles appeared before Ja's Boot Reg'r and swore that he saw Thomas Montgomery sign and seal the document and saw David Thomas Jun'r and Robert Montgomery sign their names. On 26 December 1794, Robert Montgomery appeared before Ja's Boot Reg'r and swore that he saw Thomas Montgomery sign and seal the document and saw David Thomas Jun'r and Samuel Eccles sign their names. "Testam'y Bond Thomas Montgomery January 5, 1794". Sam'l Eccles and Anth'y Durham, Appr's. On 5 January 1795, "Mary Montgomery of Virginia, Widow, and Hugh Morrison, of St. Georges Hundred in the County of New-Castle, are held and firmly bound unto the State of Delaware, in the sum of One thousand Dollars". Mary Montgomery was executrix of the LW&T of Thomas Montgomery, formerly ("formerly" written in and "late" crossed out) of New-Castle County, deceased, was to make an inventory by 5 April 1795 and to pay debts and submit an account by 5 January 1796. Mary Montgomery (seal) and Hugh Morrison (seal). A "List of Debts due the Estate of Tho's Montgomery filed February 13, 1795". "An Inventory of the Goods and Chattes" of Thomas Montgomery, "Blacksmith, of Botetourt County in the virgina State", reported "No goods or Chattles in Newcastle County to be found." Debts were categorized as hopeful of being collected ("sperate") or without hope ("desperate")." An acc't of his Spared debts at the Time of his decease, due in Newcastle County" included £44/0/32 from Hugh Morrison on Bond, cash rec'd from Able Miles's administrator £5/2/2, and £8 due from Nath Hanson. "An account of his desperate debts" included the balance of Anthony Durham Jun'r dec'd bond £19/2/5 and "all the small ballances in his Book acc'ts. Per Mary Montgomery Adm'x of s'd State. "Settlement Thomas Montgomery May 14, 1806"." "The account of James Lackey and Mary his wife, who by the name of Montgomery was Executrix of the Testament and Last Will of Thomas Montgomery late of St. George's Hundred and County of New Castle, Blacksmith deceased, as well as, and for such, and so much of the Goods, Chattels, and Credits of the said Testator, as have come to their hands and possession, as of, and for her payments and disbursements as follows, to wit,".]". The £44/0/32 due by Hugh Morrison's bond was assigned to Doctor William McMechen. It was figured as $117.37. "The accountant represent to the Register that the Testator died in the State of Virginia, and that there was no goods or Chattels whatever within this State." Per James Lackey and Mary Lackey (their signatures). A balance of $113.56 remained in the hands of the Executrix to be disposed of according to the LW&T which went to the Executrix. Examined, adjusted, allowed, and passed, the 24th Day of May A. D. 1806." References
