    Will of James Kitto - Died 16 Jul 1888 Source _ PRO - Series 45 Record No. 359, VPRS No.28/PO, Unit No. 569, VPRS 28/P2 , Unit 309, VPRS 7591/P2, Unit No. 176 James Kitto's will, dated 16 Dec 1887, left everything 'to my beloved wife, Cath erine Kitto, during her life. After her death everthing is to be sold and the p roceeds to be divided equallly amongst my children and my wife's children or the ir heirs or administrators. I hereby appoint Thomas Cox (sic), Nathalia, Storek eeper, William Stear, Lake Charm, Kerang, farmer executors'. When he died his estate was valued at L130. There were no liabilities. Real Estate-Crown Allotment 5 Sect. 6B Parish of Nerring, Co of Bendigo comprisi ng 1 rood on which is erected a brick dwelling house containing 3 rooms and a wo oden kitchen. The land with improvements thereon are rated at L16p.a. by the Bo urough of Eaglehawk - value L120. Personal Estate - Furniture valued at L10 Probate was sworn by Catherine Kitto who signed with her mark. An affidavit fil ed by Catherine on 17 Dec 1889 states that the executors have not taken any step s to finalise probate 'so that has left me, his lawful widow, and Ellizabeth Jan e Andrews (sic) of Elmore, Julia Hoskins (sic), wife of Thomas Cox, of Nathalia , aforesaid storekeeper, and William Kitto, Swan Hill, butcher, his only survivi ng children. I calim entitlement to administration of the estate' Affidavits filed 12 May 1890 - REnunciation as executors sworn by William Stear , William Bennetts Kitto and Thomas Cocks - 'do fully and absolutely disclaim an d renounce all my right and title to probate as executor of the will.' (why di d Wm renounce when he was not executor on the original will?) Affidavit filed 13 Dec 1890 (dated 9 Dec 1890). Articles 1-7 just identificatio n etc. Article 8. - That letters of Adminnistration with the Will annexed, of e state of the siad deceased were granted to the said CAtherine Kitto, widow of th e dec., on or about 19 May 1890, but the said Letters of Administration with th e Will annexed, of the estate of the said Catherine Kitto died before entering i nto the necessary bond and before the issue of the said Letters of Administratio n to her. Article 9. - That the said Catherine Kitto died 15 Jun 1890, intestat e. Article 10. - That his surviving children (named) were the only persons enti tled by law to share in the distribution of his estate. Letters of Administration dated 20 Dec 1890 - granted to William Bennetts Parson s Kitto, Swan Hill, butcher, the only son of the said dec. Thomas Cocks, Nathal ia, storekeeper and William Stear of Lake Charm, farmer -executors named in th e Will having renounced their right to Probate. William Bennetts Partson Kitt o having been sworn to collect and administer the estate. Affidavit by George Walker the elder, Swan Hill, gentleman on 28 Feb 1891 on th e sureties in the estate of Hames Kitto. I am worth property to around L130 an d above what will pay all my debts and liabilities. Property consists of Butche rs Premises, Campbell St., Swan Hill - a shop and private dwelling house. Affidavit by James Heppingstall Long, Swan Hill, on 28 Feb 1891 also swearing h e was worth L130, property consisting of 10 acres of freehold land at Swan Hill.

It's just one year today, since dearest mother was called away. The blow wa s hard, the knock was loud. The day that dearest mother was laid in her shrouc . A loving kind mother, an ever true friend, Heaven her portion and peace was h er end. Long was her sickness, patient in paid, Looking to Jesus heaven to gain . We miss thy dear face and thy voice, oh, how sweet. But, oh dearest mother w e hope we shall meet, To join hand in hand in heaven above, Where all is peac e and joy and love.     James Kitto came out to Australia in 1858 leaving his wife and children behind . He travelled with his brothers-in-law, Caroline's(his first wife) brothers . Caroline was preggnant with thier last child so perhaps that is why she did n ot go with hime, or perhaps their second daughter, May Hanna was sickly (she die d in 1863) but she never saw him again as she died in Germoe on 22 Aug 1864 an d is buried there with Mary Hanna. It must have been quite a reunion when he me t his children again after 10 years when they arrived Mary Hanna. It must hav e been quite a reunion when he met his children again after 10 years when they a rrived in 1868. I assume the children lived with their eldest sister, Elizabet h Jane, who married Peter Andrew about 1864, after their mother's death.
