Transfer of N. H. Lot No. 31 in 2 Range Farnham

On the twenty fourth day of August, in the year of our Lord, one thousand eight hundred & thirty six, in forenoon: Before the subscribing Notary Public, residing in the Seigniory of St. Armand, in the County of Missiskoui, in the District of Montreal, in the Province of Lower Canada, personally came & appeared Joel Rollin of the Township of Stanbridge, in the said County, trader, who in presence of us, the said Notary, & of the witnesses herein after named, voluntarily declared & acknowledged that for & in consideration of the sum of seven hundred & fifty dollars, unto him in hand, well and truly paid, before the signing hereof, he the said Joel Rollin hath ceded, sold & transferred, & by these presents doth cede, sell, transfer, assign, & make over unto Seneca Paige of Dunham in the said County, trader, present hereto & accepting
(e.o. page 1) all, his the said Joel Rollin’s rights, interests, claims, & demands, whatsoever of in, & to the equal north half of all that tract & parcel of land, situate, lying & being in the Township of Farnham in the County of Shefford in the District aforesaid known & distinguished by Lot Number thirty one, in the second Range of lots, in the said Township & of, in, & to, all the buildings & other improvements erected & made thereon as the said moiety of lot now is, be its contents what it may, & as the same has been sold & adjudged unto one Abel Whitford (now in possession & occupancy of the said premises) by the Honorable William Bowman Felton, commissioner for the sale and management of Crown Lands, in the Province aforesaid, on the 29th day of February which was in the year of our lord 1832 which said Abel Whitford, here present, forthwith voluntarily in our presence admits & disclares he, on or about the
(e.o. page 2) twenty fifth of September, AD, one thousand eight hundred & thirty did for a valuable consideration, cede, sell, & quit all of his claims of, in & to the said piece & parcel of land & premises unto the said Joel Rollin, who, in our presence also, admits that he hath since allowed him, the said Abel Whitford, to reenter upon & to this day, possess the same premises, which conformably with his certain bargain with the said Joel Rollin, in regard to his occupancy thereof, he covenants & agrees to evacuate & peaceably quit, all & singular the same on the first day of April now next ensuring upon the first demand of him the said Joel Rollin, or him the said Seneca Paige, his heirs, executors, curators, or administrators or assigns, either of whom may, by virtue of these presents, at that day enter upon & take possession of, the said moiety of lot of land & premises &
(e.o. page 3) the same use, & enjoy, as rightfully as he, the said Abel Whitford already hath & might hereafter under & by virtue of the written permissions & conditional promise of Letters Patent, of & for the said piece of land, unto him given by the aforesaid William B. Fulton, on the aforesaid 29th day of February: Therefore he the said Abel Whitford pursuant to his bargain & transfer afore alluded to, with the said Joel Rollin, & in compliance with his, the said Joel Rollin present bargain & transfer of rights & claims, etc., unto the said Seneca Paige, doth hereby, in our presence with the consent of the said Joel Rollin, promise & agree to & with the said Seneca Paige, that so soon as immediately after the Letters Patent here above alluded to if the same should issue in his own proper name, or be obtained by his heirs, executors or administrators, he will upon the first demand of
(e.o page 4) him, the said Seneca Paige, his heirs or assigns, by good & sufficient conveyances in the Law, transfer, convey & confirm, unto him he said Seneca Paige, his heirs or assigns, all & singular the aforesaid bargained piece & parcel of land, with all the buildings & other improvements, which may then have been made, & be yet standing within its boundaries; provided however that he the said Seneca Paige shall have till them paid every part & parcel of the purchase money, of the aforesaid moiety of said lot, specified in the above mentioned written promise of Letters Patent, the interest upon which now accrued & which shall accrue thereon to the aforesaid first day of April next, he the said Abel Whitford, & likewise he, the said Joel Rollin, take upon themselves jointly & severally to pay & acquit on pain etc.
(e.o. page 5) well understand also on the part of the said Seneca Paige that he shall be held to pay & satisfy all the payments of the said purchase money, & the interest thereof, as the same shall arise due, from & after the said first day of April now next ensuing: Until when they the said Abel Whitford & Joel Rollin the latter for the former specially & respectively agree to pay & satisfy as aforesaid on pains etc. For the due fulfillment & performance, of each & every the covenants on their respective part hereby entered into, they the said Joel Rollin & Abel Whitford in our presence, do hereby jointly & severally, bid & oblige themselves especially as regards the payment of the interest of the purchase money & every part & parcel thereof, until the said first day of April next. Thus the said parties have consummated & declared & for the
(e.o. page 6) due executions of these presents, make election of their domicil, each at his place of abode, whence etc., notwithstanding etc. Thus done & passed in the office of the said Notary the day & year, first before written in the presence of (blank space) the said witnesses; and the said parties & we the said Notary & witnesses have to these presents, (first duly read) set & subscribed our respective names, in faith & testimony of the premises.
