Analysis:Wills of John and David Walker, Goochland County, VA, 1740

The following two wills in Goochland County records were both written in 1740. One is for a John Walker Jr, son of John Walker, and the other for a David Walker. Neither person appears to have been married, and both leave the bequests to a John Walker, (identified by one as his father) and their brothers and/or sisters.

A comparison of legatees in the two wills:

John does not identify any sisters, but his list of brothers is the same as Davids, except that David includes only a John Walker whose relationship is not specified, but is probably his father. Two out of three witnesses are the same persons. David It is difficult not to conclude that John and David were brothers.

April 30 Will of John Walker, Jr. of Goochland Co., father John Walker, all my 400 acres and plantation on branches of Lickinghole Creek, bro James Walker, 400 acres on the Byrd, purchased of Thomas Clark, bro Joseph Walker, negroes, bro David Walker, patent of 400 acres on branch of Little Byrd Creek and 1 negro. 1740, Nov 18 Goochland Co., VA Court, Order Book No. 4 The last will & Testament of John Walker, Jun. dec’d is presented in Court by Joseph Walker his Executor who makes oath thereto and the same being proved by the Oaths of William ATKINSON and Richard ATKINSON is admitted to Record and on the motion of the said Executor Certificate is granted him for obtaining a probate thereof in due form. Ordered that Thomas SAUNDERS, Josias PAYNE, Thos. Maserd and William MARTIN or any three of them being first sworn by some Justice of Peace do appraise the estate of John Walker, Junr. deced. and that his Executor do return an Inventory thereof to the next Court.
