In the name of God amen! I John Dake, Sr. of this County of Shenandoah and state of Virginia being weak in body but of sound mind and memory do make and publish this last will and testament in manner following.
First, I recommend my body to the earth from where it was taken to be buried in a decent and Christian like manner, and all burial charges together with my just debts to be paid out of my financial estate.
And further it is my will. I give and bequeath unto my beloved wife Catherine all my real estate in her possession during her natural life and after my said wife's decease.
I give the said real estate unto my son John Dake and to his heirs and assignes forever for which he my said son John Dake is to pay the sum of two hundred fifty pounds current money of Virginia to my four daughters, namely Elizabeth Dake, Magdalena the wife of Peter Haller, Barbara Dake and Eve Dake To be equally divided among my said four daughters their and theirs alike: And further it is my will, I give unto my said son John Dake my wagon, one [ ] and gears, one plough, one log chain and one axel and grubbing hoe for which he my said son is to pay twelve pounds current money to my executor herein after named.
Further, it is my will, that the above mentioned two hundred fifty pounds which my said son is to pay, he is to pay, it in the following manner, twenty pounds current money he is to pay twelve months after my said wife's decease and so owe twenty pounds annually until the whole is paid.
And further it is my will that my three daughters namely Elizabeth, Barbara and Eve each of them shall have one bed and furniture, one cow, one chest and one spinning wheel and further it is my will that all the remainder of my personal estate not heretofore willed.
I give and bequeath unto my said wife Catharine in her possession during her natural life and after her decease the said estate shall be equally divided among all my children namely, John Dake, Elizabeth, Magdalena, wife of Peter Holler, Barbara and Eve. Excepting Magdalena's share is to be deducted ten pounds for which I have heretofore given her a hand to that amount of ten pounds, and further it is my will that if it should so happen that my said wife should marry again, then it is my will that she shall have no more of my real and personal estate than what the law will allow her.
And further it is my will and I do appoint my friend George Santz executor of this my will and testament in trust to take care and perform the same according to my true intent and meaning.
And I do hereby revoke disallow and disavowal all and every other will or wills by me hereto fore made ratifying allowing and confirming this one here to be my last will and testament.
In writing and whereof I have hereunto set my hand and seal this second day of January in the year of our Lord one thousand eight hundred fifteen.
