Know ye that I NICHOLAS SMITH of Essex County do out of pure Love and Natural affection which I have and bear unto my Son FRANCIS SMITH do by these presents make over one Track of land to my said Son FRANCIS SMITH and to his heires forever, Begining at a Poplar tree in a line that parts me and JOHN GEORGE upon a Swamp side and so down the Run of the said Swamp to the CHURCH SPRING BRANCH thence up the said Branch to the CHURCH SPRING and so along the PATH from the CHURCH SPRING to the CHURCH thence down the ROAD to the WHITE MARSH BRIDGE and so down the said Swamp till it comes to the line between JAMES HIPKINS and me and along that line to a Corner tree in HIPKINS tobacco ground and along the line that parts HIPKINGs, JOHN GEORGE & me to a Mulberry tree thence to another Mulberry tree and so along a line to a poplar on the Swamp side the begining place the said Land contains four hundred acres the said land contains my Dwelling Plantation which I do except, I do acknowledge unto my loving Son FRANCIS SMITH the above tract of land unto him and his heirs forever. KNOW ALL MEN by these presents that I THEODORICK BLAND of the County of PRINCE GEORGE Gent am firmly bound unto FRANCIS SMITH of the County of Essex Gent. in the sum of Four hundred pounds Current money of Virginia the Sixteenth day of June in the year of our Lord one thousand seven hundred & Forty one WHEREAS the above bound THEODORICK BLAND & FRANCES his Wife in right of the said FRANCES are seised in their demense in a moiety of five hundred & Ninety acres of land with the Appurtenances in sd County of Essex four hundred & forty acres of which was purchased by FRANCIS MERIWETHER Grand Father of the said FRANCES of RICHARD BUSH & the Residue thereof purchased by MARY MERIWETHER Grand Mother of the sd FRANCES of the said RICHARD BUSH
THE CONDITION of this obligation is that if said THEODORICK BLAND & FRANCES his Wife do at the request of said FRANCIS SMITH after the sd FRANCES shall attain the age of Twenty one years or if the heirs of the said FRANCES in Case she dies before the said age shall as soon as by Law they are Capable so to do convey & make over unto the sd FRANCIS SMITH his heirs & assigns the said moiety of the said five hundred & ninety acres of land with a General Warranty & free from all manner of In cumbrances & if said FRANCIS SMITH shall be permitted in the meantime to hold & enjoy the same without any Interruption That then the above obligation to be void otherwise to remain

Francis Smith, of South Farnham parish, Essex Co., member of the House of Burgesses, 1752-'58, and was his second wife. He died in 1762 [Essex Records], leaving issue by his first wife Lucy Meriwether, Col. Meriwether Smith, and two daughters ; and by his second wife, Anne Adams,
    i. Francis Smith, of "Piscataway," Essex Co., and subsequently of Georgia ; married Lucy Wilkinson, and had, with other issue, Thomas Adams Smith (b. 12 Aug., 1781 ; d. 25 June, 1844), Brig. General U.S. Army, whose eldest child, Lucy Anne Smith, (b. 11 Nov. 1812 ; d. 18 Feb., 1867), married Judge Beverly Tucker, Professor of Law in the College of William and Mary, &c.
    ii. William Smith, member of Essex Co. Committee, 1774, House of Delegates, 1778, etc.; married Mary, daughter of John and Ruth (Sydnor) Belfield, and died in 1785, leaving issue.

    CAPT. NICHOLAS SMITH (Nicholasl), of South Farnham Parish, in the county of Essex, was appointed a justice between 1720 and 1730, and was vestryman in 1739. (Meade, 1. pp, 393, 405.) He gave a bond as sheriff and collector in 1730. By deed, dated 15 July, 1729, he conveyed to his son Francis 400 acres of land in Essex, "being the dwelling plantation of the said Nicholas Smith;" and in 1733 conveyed land by deed to his son Nicholas Smith, Jr. Administration on his estate was granted 16 August 1757, to his son Nicholas the petition setting forth that he died in testate, and that Francis Smith was the elder son, but resigned his "right of administration" to his brother. (Essex Records.)

    COL. FRANCIS 3 SMITH (Capt. Nicholas2, Nicholas1) of South Farnham Parish, in the county of Essex, was vestryman and justice, 1740 (Meade, 1, pp. 393, 405); major of horse, 1753, and afterwards colonel (Cal., Virginia State Papers, 1, p. 247); member of the House of Burgesses for Essex, 1752-'58. (Journal; Virginia Magazine History and Biography, 111. p. 192; Gazette.) His will (dated 5 Mar. 1760; proved 15 Mar. 1762), disposing of a large estate, mentions, besides his children, his wife Anne, who received for her life in lieu of dower, "half of all my lands at the lower church in South Farnharn Parish," other lands then in possession of her mother, Mrs. Tabitha Adams, widow of Ebenezar Adams, of New Kent County, eleven designated slaves, riding chair and horses, and other horses; thirty head of cattle, twenty sheep, hogs, farming implements, "looking glass in the chamber over the hall; a dressing glass which stands in the lower chamber; two of my best beds and furniture; two black walnut tables; one dozen chairs, now standing in the hall; all my plate and china; half the kitchen furniture, and my black walnut desk;" friend Thomas Adams "a mourning ring of the price of two guineas;" son Meriwether "choice of my swords;" "my books to be equally divided among my three sons;" wife Anne, son Meriwether and friend (brother-in-law) Thomas Adams executors. (Essex Records.) He married, first, about 1729, Lucy, daughter of Francis and Mary (Bathurst) Meriwether, of Essex, who was living 21 Oct. 1740, and had issue (named in will):
