Will Transcript

North Carolina, Iredell County
Know all men by these presents that I David Caldwell of the County & State aforesaid being sound in mind & memory this 15th? day of April 1808, so make this my last Will & Testament in the following. Viz, that my Body be Buried in a decent manner at the discretion of my Executors hereafter mentioned & named.
Item 1st. I give & bequeath unto my beloved Wife Rebecca all the part of the tract of land I now live on that lies on the North side of fifth Creek except what the Mill Peron? may cover ~ also I except one Acre of land for the use of Publich, to be laid off by my Executors, where the Grave Yard is now near to my House. I leave the above land to my Wife Rebeccka during her natural life only, also one Negro Girl Hannah ~ one Bed & furniture which she has in her possession, one half of the Cow Cattle & Sheep, one fourth part of all my Hogs, one half of my Kitchen furniture, one Horse of the value of Sixty Dollars, The Cattle, Sheep, Bed, Kitchen furniture to be at here own disposal, the remainder that is, Willed to her I allow to go to my two Sons John & Timothy Heyram at her Death, Further I give her during her natural life from the Centre of the Entry of the South end of the House I now live in ~
Item 2d. I give & bequeath to my son David all my part of the tract of land ownx? Abner Sharpe, Adlai Osborn & Myself, known by the name of the Iron Ore tract on the Waters of Rockey Creek, begining on Wm. McConnells corner.
Item 3d. I give & bequeath to my Daughter Patsey Cowan One hundred & fifty Dollars, to be paid by my Sons John & Timothy Hyram Equal as soon as the may, sell any of the land owned by Osborn, Sharpe & myself to that Account & have collected this Money?
Item 4th. I give & bequeath to my Sons John & Timothy Hyram all the lands & tracts of land adjoining where I now live being seven in number. Also all the part of the tract of land I now live on, except what is Willed to my Wife Rebeccka during her natural life & then to be John's & Hyram's with all Buildings, Mills & Machinary & all Utenticla belonging to them.
Also Caleb, Erakiel & Joe & the remainder of my Stock of every kind not otherwise disposed of, all my Plantation Tools, the Waggon & Gears, & the Plantation I bought from William Simonton, & all the Lands, unsold & not disposed of, otherwise that is in Partnership between Adlai Osborn, Al Sharpe & Myself, all the remainder of Household Kitchen furniture. Also two tracts of land on Hunting Creek owned by me joining each other [Also all Debts coming to me by Bonds Notes of Book Accts or otherwise] ~ Also all Monies that I may have at my decease. Also all my Property Real & Personal that is not otherwise disposed of to my Sons, John & Timothy Heyram on their paying out of their parts, all my Just Debts. Should either of my Sons, or Hyram die without the Other be his soal [sole] heir.
I hereby appoint my son John Caldwell & Robert Simonton Executors of this my last Will & Testament, revoking all former Will.

    At his seat in Iredell county, on the 9th, Col. David Caldwell, for many years a member of the state legislature, and an active and useful magistrate in his county, He possessed many virtues, more than commonly fall to the lot of one man: His feelings were ever alive to perform those duties which are due to society.
