Estate Records

• In the fall of 1781 John McClung Sr., was taken to the home of son, John McClung, Jr. shortly after his wife died and before he quit housekeeping. Not content there, he returned shortly to his own home. After his daughter, Janett, married, he lived with Nancy [McClung] Moore from the Spring of 1782 until his death in 1787. His estate was in litigation for many years. All children, many grandchildren, and depositions from them and other people were recorded in Chancery Court documents. A decree issued by Superior Court of Chancery held at Staunton 12-5-1810 ordered William Moore and wife Nancy [McClung], daughter of John McClung, Sr. to convey their interest in the land to Joseph McClung of Greenbrier Co., VA (Aug.Co. Chancery Ct records and Rockbridge Co. DB H, 119). Joseph McClung of Greenbrier Co., Va, sold land to John McClung, Rockbridge Co., by deed dated 10-28-1812 (Rkbg DB H,204). Administration of estate of John McClung dec., granted William Moore 2-1788 Rockbridge Co. Court; inventory and appraisement of personal estate recorded 6-7-1791, Rockbridge Co. Court.

• Rockbridge County Court, 2 October 1787. On the Motion of William Moore Esquire. Ordered that the Sheriff Summon Joseph McClung heir at law of John McClung Deceased to appear at Greenbrier Court next to take upon him the Administration of the Estate of the said Deceased of he think fit. ~

• Rockbridge County Court, 5 February 1788. On the motion of William Moore Esqr. who made Oath according to Law Certificate is granted him for obtaining Letters of Administration of the Estate of John McClung Deceased he having together with Andrew Moon his security entered into and acknowledged Bond in the sum of five hundred pounds ~ Conditioned according to Law. ~ Ordered that Nathaniel Wilson, Andrew Moore, David Steel & Saml. Wilson of any three of them being first sworn do appraise the Slaves and personal Estate of the said John McClung Deceased, and Return an Inventory and Appraisement thereof to Court.

• 10 February 1792: [Wm. Moore v. McClung's Heirs (John McClung)]: The Commonwealth afs. of Virginia. To the Sheriff of _______ County. Greeting you are hereby commanded to summon John McClung, Junr., Alexander McClung, Charles McClung, Edward McClung, Jennet McClung & Rachel McClung Heirs of Thomas McClung Deceased, Mary McClung, Jennet McClung, William McClung Heirs of James McClung Deceased & John McClung, Samuel McClung, Edward McClung & Charles McClung, Wm. McClung, David Moore & Jennit his wife Heirs of John McClung Snr. Deceased to Appear before the Justices of our Court of Rockbridge County at the Courthouse on the first Tuesday in march next then and there to answer & Bill in Chancery Exhibited against them by William Moore and this they shall in no wise Owrit [?] under the penalty of one hundred pounds each, and have then there this Writ. This answer being for himself & also as Guardian for Rachel McClung & Thomas McClung infants & orphans of the said Thomas McClung deceas. and for Jinney McClung, Sally McClung, Polly McClung & Edward McClung Infts. & orphans of Edward McClung dec'd.
• 12 November 1799: [Wm. Moore v. McClung's Heirs (John McClung, Sr.)]: The joint answer of Alexander McClung, Edward McClung & Jane McClung children of Thomas McClung dec'd and Joseph Dixon & Nancy his wife late Nancy McClung daughter of James McClung dec'd to the Bill of complaint exhibited in Rockbridge Court against them & others by Joseph McClung. These defendants saving to themselves all just proper exceptions to the Complaintants Bill for answers thereto saith - That they know only from information that the sales mentioned from their Grandfather to their Uncle James, from him to Edward & from him to the Complaint. took place - However if the Complaintant can prove to the satisfaction of the Court that said sales did actually take place they cannot in justice prove his demand. Wherefore, they pray to be hence discharged.

• 12 November 1799 - [Wm. Moore vs. Heirs of John McClung, Rockbridge County, VA] - Edward McClung & Jane McClung children of Thomas McClung Deceas'd came before me a Justice of the Peace for said County and made oath that the within file is justly stated as far as relates to their knowledge. Given under my hand this 12th day of November 1799. (Signed) James McCay.

[Note: the suit "William Moore vs. the Heirs of John McClung" in Rockbridge County establishes and proves the children of this John McClung as well as several of his grandchildren and is a key record in establishing that his son Thomas McClung DID NOT die in the celebrated Battle of Point Pleasant in October 1774, as some have written].

John McClung was born in Ulster, Ireland. He came to America as an indentured servant in 1720. He met his wife Rebecca Stuart in 1726. Rebecca Stuart was born in Galloway, Scotland in 1710, the daughter of Andrew Stuart and Eleanor Dalloway. According to Church records, she was Christened in Londonberry, Ireland, in 1710.(W.H.Egle's N&Q) After her fathers death in 1715, Rebecca resided with her brother, Archibald Stuart. She eventually accompanied him to the American Colonies, where he traveled to escape religious persecution (Source-US and Canada Passenger and Immigrations Lists-1500-1900, Source Publication Code #9255.7. While living in Lancaster County,Pennsylvania, Rebecca met and married John McClung, a Scotch-Irish immigrant who came to America in 1720 as an indentured servant. Their marriage bond (dated August22, 1726)was posted in the Presbyterian Church of a small Scotch-Irish settlement (now Pequea,PA) near Chickies Creek that had been founded in 1724 (Source-book 'Early Stuart Family Immigrants in America')

Rebecca and John originally had a homestead near the Natural Bridge in Virginia (Source-Chronicles of the Scotch-Irish Settlement in Virginia). Eventually, John McClung bought 279 acres of land in Augusta County, Va, 249 acres of which were part of Benjamin Borden's tract and 30 acres were part of King's land adjoining the same. (Source- Augusta Co. Deed Book, pg 15, 388).Rebecca and John had ten children, three of whom were heros in the Revolutionary War (Source- Sons of the American Revolution).

Rebecca Stuart McClung died in 1781 at the age of 71 and was buried on the family farm, which her husband John later sold to his son Edward. Rebecca was related to the Hon. Alexander Hugh Holmes Stuart, who was Secretary of State in President Franklin Pierce's cabinet. He was Rebecca's brother Archibald's grandson (Source-The McClung Genealogy) and it was through his descendants that it was proven through DNA that Rebecca was the mother of John McClung's children.

John McClung died in 1787, although it is often written that he died in 1788, because that was the year his will was probated. John was considered to be a patriot by the Sons of the American Revolution for the help he gave to the soldiers during the war.

   John's first wife and mother of his children was Janet Thompson, daughter of John Thompson who died in 1743. Her brothers were James, Robert, and the Thomas Thompson, administrator in the will of Robert Means. Her aunt was Nancy, wife of Robert Means.
   
   John McClung came from Ireland and settled with his cousins in what became Rockbridge County, VA. At the time he came, his wife was Rebecca Stuart. There is ample evidence that this was the second wife, and not the mother of his children. Eva Christensen who died in the 1960s had come to that conclusion after many years of research. Some of her notes were published in Journals. The following letter from Evelyn Witeck summarizes the research done by these two women:

   John McClung was born in Ireland and died in 1706 in Rockbridge County, Virginia. He was married first to Janet Thompson who died in 1743. Their children were John, James, William, Joseph and Captain Samuel. John married Rebecca Stuart after Janet's death. Their children were Thomas, Janett, Edward, Charles and Mary. The sons all settled in Greenbrier except John Jr. Daughters Nancy and Janet also stayed in Rockbridge County.
   
   - this date is obviously in error, more likely a year of birth. John McClung died in 1787 in Greenbrier County, Virginia [later West Virginia].
