Will Transcript

In the name of God Amen, I John Davis Senr. of the County of Wythe and Commonwealth of Virginia being weak in body but of a sound and disposing mind memory, Thanks be to God for his mercies & knowing that it is appointed for all men once to die, do make and ordain this & no other to be my last will and Testament that is to say.
I give and bequeath to my beloved wife Mary after my decease all my Land with the appurtenances whereon I now live, together with all my hansil? furniture and Stock of every kind during her natural life and after her decease I give and bequeath to my son Joseph the sd. Land and appurtenances with an equal part of my personal estate to be equally divided after the decease of my wife between him and the rest of my children John, George & Jacob Davies (& my three grand children Betsy, Polly, Susy Davies, Daughters of Abram Davis my son Dec'd), Betsy, Eve, Elisabeth & Barbary & Polly who have intermarried with John Hutsell, Daniel Wisely, Lewis Hutsall, Joseph & John Fannen?, and that my [son] Joseph pay to my aforesaid sons the sum of five pounds cash within one year after the decease of wife over & above their equal part of my personal estate in consequant? of my willing to my sd. son Joseph all sey? my Lands aforesaid containing two hundred & ninety __- Acres by petent & entry hereby revoking & disannuling all others and ratifying & confirming this and no other to be my last will and Testament.

This last Will and Testament of John Davis Dec'd. was proven in Court by the oaths of Robert Crockett and John Sifer the Witnesses thereto and ordered to be recorded.

    John Davis, Jr., They divorced in 01/09/1798, but could have been separated long before that. Unsure of who his wife was. Some sources say Elizabeth, others say Mary.
    George Davis, m.Leah (unk) - b. 1762 moved to Grayson Co. Kentucky. George Davis married Mary Courtee.
    Jacob Davis, d.1826 and was buried in the old St. John's Church yard. He m.Margaret (unk)
    Abram Davis (deceased). b. 1795. Wythe County Virginia United States married Mary Polly Smith Finn.
    His daughters were

    Betsy, born 1755, married John Hutsell
    Eve, born 1753, m. Ludwig Lewis Hutsell
    Elizabeth, Elizabeth Davis born 1773 m. Daniel Wisley, d. sometime before Apr 11, 1846.
    Barbara, b. 1766 d.c 1817 m. Apr 8, 1790 Joseph Fanning
    Mary Polly Davis m. John Fanning b. 1769. 1799 - Feb: Polly Davis presented a petition to court and she was granted the right to bring action against her husband John for alimony.
    and they had married John Hutsell, Samuel Wisely, Lewis Hutsell, Joseph Tanner and John Tanner. Witnesses, R. Crockett and John Sifer. [Wythe Co., VA Will Book 1, pages 90 & 91]
