Notes
- Jacob Tyree, Jr. b. 3-6-1768; his estate began early -- from 1790 to 1810 he was taxed for 9 slaves. From Amherst Co., records, Feb. 17, 1822, Jacob and his wife Martha sold 246A for $900 to Tandy Rutherford on south borders of the Buffalo. Jacob’s will 8-11-1844 ; codicil Aug. 31, 1846; he d. 2-8-1847 with probate date of 4-19-1847 Amherst Will Bk. 21, p.7; will speaks of land "rented to Wm. A. Tyree"; it lists his children and among them includes Charles H. Massie (the Charles H. Massie who is listed elsewhere as having married Sophie Tyree?); also noted in the will that Jon. H. Tyree was his debtor, inventory by C. J. Tyree; his wife was Martha (this Martha b. 3-1-1781, according to Amherst Census 1850 she held a value of $2000).
- Back on Jan. 9, 1803, a Sunday afternoon in Amherst Co., Jacob Tyree had m. Martha “Patsy” Allen, with Rev. James J. Tyree officiating, permission by Martha’s mother Hannah Allen Hylton, widow (father had been Samuel Allen who d. 9-17-1799 at 46). Interesting suit from Augusta Co. records 1814 of Allen versus Hylton: Martha, w. of Jacob Tyree was complainant (being joined in complaint by her sisters Bethinia Allen Camden (m. to Leroy Camden) and Lucy Allen Tindall (husband Geo. H. Tindall d. 5-18-1814) along with Martha’s brothers George, Jesse, Samuel H. and John Allen: all children of Hannah, d. 6-13-1826 at 72yrs. 1 mo. 7 days, and Samuel Allen; plus grandchildren of deceased daughter Lucy: George, William, Nancy, Susan and Martha Tindall; and Hannah wife of James Edmonds, Bethinia Allen widow of John Allen and a daughter of James Nevil of Albemarle who owned property in her own right from her father. They were contesting the division of their grandmother’s estate; grandmother’s name Bethinia Nevil Allen Hylton, d. 8-4-1843 -- which suggests that the names Bethania and Bethemia entered the Tyree family from above grandmother; Bethinia’s father was James Nevil of Albemarle Co.; she was the widow of John Allen; she later co-habited with George Hylton who d. July 1812 but for inheritance purposes in 1843 had to prove marriage; the suit decided they were married.
