Will Transcript

In the name of God amen
I Isaac Scott of the county of amherst and State of Virginia do make this as my last will. Item my will and desire is that all my property real and personal be sold as so after my death as my Executor hereafter mentioned may think best and upon such terms as he may deem most advisable and the proceeds be disposed of in the following manner - first all my just debts to be paid that one third part of the balance be loaned my wife Martha during life time to be returned to my estate at her death. That the balace of the money after deducting the third part loaned my wife, be divided among my eight children as follows, one fourth be given to my daughter Martha and the ballance equally divided among the other seven to wit, George Scott Rutha Scott wife of Fleming Scott Elizabeth Mays Catherine Carpenter, Mahala London Samuel D. and John w. Scott.
Item It is my will that my son George account to my executor for the amount of an execution paid by me for him to D? & D. Higginbotham and have the amount deducted from his portion of my estate and that my daughter Rutha have deducted in like manner eighty dollars paid by me for her husband Fleming Scott and that my son Samuel D. Scott have deducted in like manner eighty dollars paid him by me and that my daughter Mahala London have deducted in like manner fifiteen dollars for a cow and calf furnished her by me--each of my eight children except my daughter Martha, and my son Samuel D. Scott have been furnished by me with a bed and furniture for which I charge them fifteen dollars each and my son John w. Scott has been furnished a horse by me of thirty five dollars which he is to accoutn for to my estate.
Item. The money loaned my wife to be divided at her death in the same proportion among my children that may be then living or their heirs as I do now apportion the money arising from the sale of my Estate.
Item. I appoint my friends Charles Tucker and Wm. W. Waller executor of this my last will and testament. witness my hand & seal this 13th day of June 1840

Examined
In a court held for Amherst County on the 20th day of July 1840-this paper purporting to be the last will and testament of Isaac Scott deceased was prduced in open court by William M. Waller- in ordr to be proved and thereupon Wiatt London enters himself as contestant thereof and the same is continued_
And at a court held for Amherst county on the 21st day of September 1840 was again produced in open court and the said Wiatt London withdrawing his objections to the probat thereof the same was proved by the oaths of Charles Tucker and Ansel Mays subscribing witnesses thereto and ordered to be recorded.

Know all men by these presents that we Wiatt London John Scott Austin Carpenter & Joel Mays are held and firmly bound unto Nelson Crawford, Jonas Pierce, H.L. Davies & W.M. Waller gentlement justices of the Court of Amherst County now setting(?) on the sum of one thousand dollars lawful money of Virginia to be paid to the said Justices and their successors in office for the payment whereof well and truly to be made we bind ourselves and each of us our and each of our heirs, executors and administrators jointly and severally, firmly by these presents sealed with our seals and dated this 19th day of October 1840 and in the 65th year of the commonwealth .
The condition of this obligation is_that if the said Wiatt London & John Scott Administrators with the will annexted of Isaac Scott deceased, do make a true and perfect inventory of all and singular the goods chatels and credits of the said deceased, which have or shall come to the hands possession or knowledge of them the said Wiatt London & John Scott or into the hands or possession of any other person or persons for them and the same so made do exhibit to the County Court of Amherst at such time as they shall be thereunto required by the said court and the same goods, chattels, and credits do well and truly administer accordiing to Law and make a just and true account of their actings and doings therein when thereunto required by the said Court. And further do well and truly pay and deliver all the legacies contained and specified in the said will as far as the said goods chattels and credits will extend according to the value thereof and as the law shall charge them this obligation to be void, or else to remain in full force.
