Will of Henry Davis

Will Book I, pg. 297-299
I Henry Davis of Wythe County and State of Virginia do hereby make my last will and testament in manner and form following. That is to say.
1st I desire that all my just debts and funeral expenses be paid out of my estate as soon after my decease as possible.
2ndly I give to my wife Jean one third part of my old plantation I now live on, the house and household furniture also four negroes Luke, Dinah, Jude & Patsy also one horse and one mare and plough and gears for two horse also two Cows and one third part of the hogs & sheep and one bed and furniture during her life or widowhood, and after her decease or marriage I give one fourth part of the same, the land and Dinah a negros woman expected to my two daughters Jeane & Mary and the other three-fourths to my 3 daughters Nancy Caty and Rodah to be by them enjoyed forever.
3rdly I give to my Son James Ten shillings and no more of my estate.
4thly I give to my son Henry the plantation I now live on to be bounded by a conditional line made by my sons Wilson and Henry up big Reed Island to include the saw and grist mills to be by him enjoyed forever, except the third part already given to my wife during her life or widowhood. I also give to my son Henry one negroe girl named Sall and two cows to be enjoyed as aforesaid.
6thly I give to my Daughter Mary one negroe woman named Luckey to be by her enjoyed forever.
7thly I give to my daughter Martha ten shillings and no more of my estate.
8thly I give to my Daughter Nancy one black mare four years. Saddle and Bridle one bed and furniture and 2 cows the same to be enjoyed forever.
9thly I give to my daughter Caty one bay mare three years old saddle and Bridle one bed of furniture and two Cows the same to be enjoyed forever
10thly I give to my Daughter Rodah one brown mare, saddle and bridle and two Cows the same to be enjoyed forever.
11thly I give to my son Jamesses son Wilson eighty acres of Land lying in Grayson County on Lindseys path one Sorrel Colt three years old saddle & bridles and two year old heifers the same to be enjoyed forever.
And lastly I do hereby constitute and appoint my friends James Calfee and John T. Sayers executors of this my last will and Testament hereby revoking and making null all other former Wills and Testaments by me hereto made. In Witness whereof I have hereunto Set my hand and affixed my seal this 10th day of August 1804

A Codicil to the Will above written I allow my executors to pay out of the money comint from my son Willson Davies and my still and the other part of my estate not yet disposed of to pay unto Nance and Caty each a sum equeal to Rhodah and If any overplush should yet remain with one negroe named Pet already mentioned in my Will after my Wifes Deces or mares to be equally divided between my five daughters Jean Mary Nace Cate and Rodah In Witness whereof I have hereunto set my hand and affixed my seal this thirteenth day of August One Thousand eight hundred and four.

  • Vol. 2 - Whitlock vs. Whitlock--O. S. 30; N. S. 10--Petition for Certiorari filed September, 1799. Agness and Hanna, infant daughters of Charles Whitlock, decd., by Wm. Davies, their guardian, complains that Thomas Whitlock, father of Charles, owned land on Reed Island in Wythe County and promised to convey it to Charles, if Charles would marry Mary Davies, the daughter of Henry Davies, which marriage took place. James Ingram deposes in Wayne County, No. Ca., 10th March, 1804. Richard Christal deposes in Wayne County, No. Ca., 10th March, 1804. John Hammons deposes in Wayne County, No. Ca., 10th March, 1804. Thomas Brooks deposes in Wayne County, No. Ca., 10th March, 1804, son-in-law of Thomas Whitlock. Charles Whitlock was killed by the fall of a tree.
