DISCLAIMER AND QUITCLAIM DEED.

STATE OF LOUISIANA. PARISH OF ASCENSION.

KNOW ALL MEN BY THESE PRESENTS: That we, J. FORREST LANOUX, married only once to and now living with Willie St. Amant, resident of Ascension Parish, Louisiana, PAUL ROBERT LANOUX, married once to and now living with Julia Mae Taylor, a resident of New Orleans, Louisiana, and J. BURRIS LANOUX, married twice -- first to Callie Grantham, deceased, and second to and now living with Jeanne Hamilton, resident of East Baton Rouge Parish, Louisiana, (sometimes hereinafter referred to as FIRST PARTY), and ALODIA LANOUX, widow of H. Clay Lanoux, deceased, resident of Ascension Parish, Louisiana, (hereinafter sometimes referred to as SECON PARTY), do make and enter into the following agreement:

WHEREAS, on April 29, 1933, Joseph Lanoux and wife, Estelle Eliser Lanoux, conveyed, transferred and delivered, by warranty deed, to their daughter, Alodia Lanoux, wife of H. Clay Lanoux, a certain tract or parcel of land, situated in Ascension Parish, Louisiana, together with all improvements thereon, more particularly described in said deed, which is recorded in Conveyance Book 72, page 516, records of Ascension Parish, Louisiana, which said deed is made part hereof, by reference, for all purposes; and,

WHEREAS, some question arose as to the correctness of the description of the property thereby conveyed and intended to be conveyed and on March 5, 1949, Estelle E. Lanoux and all the heirs of her deceased husband, Joseph Lanoux, excepting SECOND PARTY, executed a quitclaim deed to and in favor of SECOND PARTY, covering the property hereinafter described, which deed is recorded in Conveyance Book 90, page 9, records of said Parish of Ascension and State of Louisiana, which said quitclaim deed is made party [sic] hereof, by reference, for all purposes; and,

WHEREAS, said deed, first hereinabove referred to and described, recited a cash consideration, thus giving rise to the presumption that said property fell into the community of acquets and gains existing bwtween her and her said husband; but in truth and in fact said deed was a disguised donation to and in favor of their said daughter, Alodia Lanoux, and no consideration was paid therefor, same being a donation inter vivos, as an advancement to her out of their estates; and thus becoming the separate and paraphernal property of the said Alodia Lanoux, under her separate control and administration, and forming no part of the community of acquets and gains existing between her and her said husband; and

WHEREAS, the said H. Clay Lanoux departed this life, intestate, at his domicile in the Parish of Ascension on the 19th day of June, 1949, leaving as his sole and only heirs at law the persons hereinabove named as FIRST PARTY, each of whom is a major and suffering under no legal disabilities or capacities, who as such heirs of said H. Clay Lanoux, are the owners of all property owned by him at his death; and,

WHEREAS, said FIRST PARTY acquired no interest in said property by virtue of inheritance from their deceased Father, H. Clay Lanoux, the adequacy of which is hereby acknowledged and full acquittance and discharge therefor hereby given, we J. FORREST LANOUX, PAUL ROBERT LANOUX, and J. BURRIS LANOUX do hereby grant, sell, assign, convey, set over and quitclaim, without warranty, either express of implied, unto ALODIA LANOUX, widow of H. Clay Lanoux, deceased, her successors and assigns, all of their rights, titles and interests, claims and demands, in and to the following described property situated in the Parish of Ascension, State of Louisiana, to wit:

"A certain tract of land situated in Ascension parish, Louisiana, being a fractional portion of the SE¼ of Section 20, T. 9 S., R. 3 E., containing secen and one-half arpents, more or less, with all the buildings and improvements thereon, being bounded on the north by the Quarter Section Line common to the NE¼ and SE¼ of Section 20, and the east by the estate of Joseph lanoux, and the south by New River, on the west by Rosa Lanoux Bercegeay."

TO HAVE AND TO HOLD said property unto said Alodia Lanoux, her heirs, executors, administrators, legal representatives, successors, and assigns, forever, so that we, or anyone claiming by, through or under us, or each of us, shall never hereafter assert any claims in and to said property last hereinabove described.

IN WITNESS WHEREOF, this instrument is signed, sealed and delivered as of the 11th day of February, 1952, in the presence of the undersigned competent and legal witnesses.

STATE OF LOUISIANA, PARISH OF ASCENSION.

BEFORE ME, the undersigned authority, a Notary Public within and for the aforesaid Parish, in aforesaid State, duly commissioned, sworn and acting, on this day personally appeared Geo. C. Cummings, to me well known to be the person whose name is subscribed to the foregoing instrument as an attesting witness, and who, being first duly sworn, deposes and says:

That he subscribed his name to the foregoing instrument at the time of the execution thereof as an attesting witness, and that he knows J. forrest Lanoux and J. Burris Lanoux, two of the three grantors named in said instrument, to be the persons described therein and who executed the same, and saw them sign the same as their voluntary act and deed. C. cummings, to me personally known to be the person whose name is subscribed to the foregoing instrument as an attesting witness, who being first duly sworn, deposes and says: That he subscribed his name to the foregoing instrument at the time of the execution thereof as an attesting witness, and that he knows Alodia Lanoux, one of the persons described therein and whoexecuted the same, and saw her sign eht same as her voluntary act and deed.
