Background

Persons bearing the Hays surname settled in what is now Derry Township, Dauphin County (then Lancaster County) Pa by 1733, and on Hays Creek in Old Augusta, VA about 1738. For convenience they are respectively referred to as the Hays Family of Derry and the Hays Family of Hays Creek. Considerable effort has been spent drawing together records for these two lineages, allowing an evaluation of their genealogical relationships. Records in Chalkley's Chronicles show that these two groups were closely related. The record, however, is incomplete, particular for the Hays Family of Derry]] and a number of issues remain to be resolved. This article identifies the principal remaining issues.

Importation Date

On 20 August 1740 Person:Patrick Hays (1) and Person:John Hays (20) swore an importation oath, declaring that they had paid for their own importation to America, and that of several of members, believed to be their wives and children. They stated that they had come from Ireland, and entered the country at Philadelphia. They do not state when they came to America or where they were living prior to taking the oath of importation. They are known from other sources to be very early settlers on Borden's Grant, and on Beverly Manor, and are likely to have been in those locations by 1738.

Land records show that Person:Patrick Hays (6), Person:Hugh Hays (1), and David Hays took out land warrants on the same day in 1737; and that those warrants were used to secure adjacent parcels in Derry Township. Court records in Old Augusta show that Hugh was the brother of Patrick (1) in Old Augusta. The near simultaneous appearance of these Hays in Derry and in Old Augusta suggest that these lines came to America together sometime prior to 1737.

A David Hays took out a warrant in the same area in 1733. If this is the same David Hays who took out a warrant in 1737, then the earliest importation date is pushed back to before 1733.
