Last Will of George A. Truax

On this day, the eleventh day of February in the year of Our Lord one thousand eight hundred and eighty-nine, Before Mr. Siméon Noiseux, Notary Public for the Province of Quebec, Canada, residing in the Town of Farnham, in the District of Bedford, and in the presence of the two witnesses hereinafter named, undersigned, Personally came and appeared Mr. George Aldolphus Truax, of the Town of Farnham, said district farmer and founder, Who being of sound mind, judgment, memory and understanding hath requested us the said Notary, in the presence of the witnesses to write down and receive in due form of law his last Will and Testament, which he has declared in the manner and form following, to wit:

I desire that all my just debts and funeral expenses be paid by my executor hereinafter named,
I give and bequeath to my dear and beloved wife Catherine Augusta Christler in full and entire property all of my moveables and inmoveable property, real estates, ready money, assets, all and whatever I may own at the time of my decease without any reserve, hereby instituting her my universal legatee.

The present gift or legacy is however made subject to the conditional and eventual substitution, hereinafter set forth. Should my said wife after my death contract marriage, then at that very time, what shall remain or can be found left of my succession or from the herein above legacy or what it should have been acquired with the produce of the sale of my said succession, or part of it or by investment or otherwise, is hereby as allowed by articles of the Civil Code 929 & 952 substituted in favor of all my children their living and to be born, in two equal shares, one half to the boy or boys and the other half to be divided equally between my daughters the living issues of my children to be counted as representing their deceased relatives according to law. If at the time of the marriage of my said wife, there is none of my children living or of their issue, no substitution is to take place; but in case the substitution should take place; all sales of either moveable or inmoveable property of my succession that may have been made by my said wife to third persons in good faith and all gifts of the same in favor of my children, are to be legal valid and perfect, hereby ratifying the same; said substitution having effect on the remainder only. I desire and order that my said wife be the full & entire proprietor of my estate during her widowhood time, and after her marriage if there is none of my children or their issue living as aforesaid. To have and to hold, used and enjoy my said property by my said legatees as aforesaid, divesting myself of the same, to vest and seize them, at the time of my decease.

I appoint my said wife sole executrix of this my last will; and I revoke all wills and codicils I may have heretofore made. The present will was thus declared by the said testator to us said Notary, in the presence of the witnesses; and read by the said Notary to the testator who declared to well and truly understand the same and to persist therein.

Done and passed in the Town of Farnham in the office of the undersigned Notary on the day, month and year first hereinabove written under the number three thousand, four hundred and thirty one of the original records of the Notary; in the presence of Messrs. Edward Donahue, merchant and Joseph Edouard Campbell, bank agent both of the Town of Farnham witnesses called for the purpose hereof, and the testator hath signed with the Notary and witnesses in presence of each other; after these presents being first duly read to the said testator by the Notary in presence of the witnesses. <signed> G.
