Will of Andrew Truax

On this twentieth day of the month of August in the year one thousand eight hundred and eighty-five in the afternoon, Before Me. Simeon Noiseux Notary Public for the Province of Quebec Canada residing in the Town of Farnham in the District of Bedford in the presence of two witnesses hereinafter named & qualified & domiciled and also hereunto subscribing, Came and appeared Mr. Andrew Truax, residing in the village of Brigham, Township of Farnham in said District, old farmer, Who being in his usual state of health and sound of mind, memory, judgment and understanding as it appeared to us said Notary and witnesses, has requested me said Notary in presence of said witnesses to receive his present last will and testament which he declares to be in the terms following, to wit:

1st, I recommend my soul to Almighty God.
2nd, All my just and lawful debts I order shall be paid and wrongs if any there be repaired by my said legatees.
3rd, I do hereby give and bequeath unto my beloved Parker Truax the sum of two hundred and fifty dollars. I declare that this is the same sum of money I loaned to him and for which I took held a mortgage on his real estate.
4th, I do give and bequeath to my beloved daughter Louisa Truax, widow of the late Charles Ray the sum of one hundred dollars.
5th, I do give to my beloved son Leonard Truax, the sum of five dollars. I consider he has already received his share in my succession. These three legacies to be paid at my death.
6th, I do give and bequeath in usufruct only for her life-time, unto Dame Lucy Ingalls my beloved wife all the remainder of all my properties either movable and immovable real estates, money, furnitures as I may have at the time of my decease, instituting her my universal legatee in usufruct during her life time and dispensing her expressly to make the inventory and to give the security required by law to enjoy in such a case, relying on her good administration and honesty.
7th, I do intend if there is something left of my succession, after the death of my beloved wife, I do give and bequeath that remainder to my children and to my wife three sisters, to wit: Sophronia Ingalls wife of Owen Fox, Laura Ingalls wife of Charles Kenney, and Lucinda Ingalls wife of Samuel Rogers, to be shared between them in equal shares.

To have, hold, use and enjoy my said properties by my said legatees at the time of my death as divesting myself of the property to vest and seize them and take possession only as aforesaid.

I do hereby revoke all other wills, testaments and codicils I may have made before this present will which alone contains my express wishes and intentions.

Thus this was dictated by me said Andrew Truax of his own and free will and read by me said Notary to the testator who declared that he understood the same and found the present will conformable with his intentions, the whole in presence of the said witnesses. Thus done in the Town of Farnham in the office of the undersigned Notary on the day, month and year above written under the number two thousand five hundred and fifty five of his original records in presence of Messrs. Elwin M. Bowker, merchant and Frederick R. Labonte, butcher both of Farnham, witnesses called for the purposes hereof & the said testator has signed with & in presence of the Notary and witnesses these presents being first duly read to the testator by the undersigned Notary in presence of the two witnesses hereinto subscribing.
