Will Abstract

From Chalkley's:

  • Page 511.--23d June, 1782. William Johnson's will--To sons, John and Joseph, 20 shillings; to daughter, Jean, 40 shillings; to wife, Eleanor; to daughters, Sarah, Rebeckah, and Margaret; Sarah to have £10 more than the others; daughter Sarah has an injured foot. Executors, James Allen, Jr., and Geo. Moffett. Teste: Andrew Anderson, Alex. Robertson, Robt. Kenney. Codicil, 5th May, 1785, transfers £10 from Sarah to Joseph. Teste: Same as before. Proved, 21st February, 1786, by the witnesses. Executors qualify.

Will of William Johnston of the County of Augusta and Commonwealth of Virginia
"To my beloved and loving wife Elenor the one third part of the remainder of my movable Estate to her use and to be disposed of as she may think proper, also one third part of the plantation I now live on the house included & an equal part of ye ___ land during her live.
"To my three daughters viz: Sarah, Rebecka and Margaret the remaining two thirds of the plantation, or the profits arising from it equally divided and at the death of my widdow - it is my will the plantation be sold and the money arising therefrom be equally divided among my three last mentioned daughters save to Sarah the sum of ten pounds more"..
Appoints "my trusty & well beloved friends James Allen [??] jnr. & George Moffett the Executors of this my Last Will & Testament"..
Dated 23 June 1782

Codicil
I William Johnston of Augusta County & Commonwealth of Virginia being of sound mind & memory thanks to almighty God though in a low & weak state of body to hereby disapprove of the ten pounds being left to my daughter Sarah in the withen my last will & Testament & it is now my will that the said Ten Pounds to be given to my son Joseph in witness whereof I have hereunto set my hand and seal this 5th day of May 1785 and it is to be likewise my Will that the above mentioned Ten pounds and all the within mentioned Legacies be not paid till sale can be made of the plantation and the money arising from said Sale can be recovered.

At a Court held for Augusta County Feb. 21st 1786.
This Last Will and Testament and the Codicil thereto annexed of William Johnston deceased was presented in Court by George Moffett and James Allen the Executors therein named and Approved by the oath of Andrew Anderson, Alexander Robertson & Robert Kenney three of the witnesses thereto and ordered to be recorded and on the motions of the said Exors who made oath according to Law certificate is granted them for obtaining probat[e] thereof in due form they having together with Adrew [Andrew?] Anderson their Security enterd into bond in £800 according to Law.

  • Vol. 1 - CHANCERY CASES REMOVED TO SUPERIOR COURT. - David Miller vs. William, John, Francis (of age), Josiah, Elizabeth and Jane Johnston, infants, heirs of John Johnston, deceased, who was heir of William Johnston, deceased; Mary Johnston, widow of John; Reuben Shackelford and Rebecca, his wife, late Johnston; Malackia Likes (Lex) and Margaret, late Johnston, devisees of William Johnston, deceased; James Allen, Sr., and George Moffett, executors of William.—Writ, 3d November, 1799. Shackelford and wife no inhabitants. Certain William Johnston died 1786 testate. Will probated devised land to three daughters. After widow's death, executors sold to Dr. John Johnson, who sold to orator, but now deceased. One, John Johnson, son of William, got possession of part of tract and died, 1797, intestate, leaving issue as above.
  • Vol. 1 - JANUARY 18, 1791. - (378) Admn. of estate of Eleanor Johnston granted Reuben Shackelford.
  • Page 331.--1st February, 1791.-- Eleanor Johnston's estate appraised by Mathew and Robert Kinney, Wm. Robertson.
  • Page 16.-[undated, appears to be abt. April/May 1792] - William Johnson's estate in account with executors--John Garvin's receipt, who married one of the legatees; Reuben Shackelford's receipt, who married one of the legatees; Elenor and Margaret Johnson's receipts.
