Will of Thomas Cloyd

Will of Thomas Cloyd, written 30 January 1842, proven in Pulaski County, Virginia, 4 October 1849:


I, Thomas Cloyd, of Pulaski County do make this my last Will and Testament in manner following. I direct my Executor hereafter named, to pay my debts, I may owe, and my first desire is for my wife Polly Cloyd to receive a comfortable living on the domain where she now lives together with my son David Cloyd, which, I hereafter will make provisions for, and should my son David Cloyd depart this life before his mother, without any heir, in this event my wife Polly Cloyd is hereby authorized to make such a disposition of my real as well as my Personal Estate as she may think proper.
I now make the following disposition of my real as well as my Personal Estate. I give to my son David Cloyd the following plantations and Parcels of land, to wit, the plantation I now live on. Also Teigg place, which lies immediately above, both of which is now called the Dunkard Bottom; and was originally called Mahanaim in the old patent for nine hundred acres granted to Garett Zin. Also all of the several tracts and parcels of land that I claim adjoining said nine hundred acres on the North and East side of New River, together with several more plantations, with their fixtures and appurtenances thereunto belonging, amounting in the whole to about four thousand four hundred and twenty-nine acres be the same, more or less, this amount includes the said nine hundred acres, also all the lands that I claim on the South side of New River opposite the Dunkard Bottom and that on the West side including Egypt, together with the several plantations, with their fixtures and appurtenances thereunto belonging, amounting in the whole to about two thousand and fifteen acres be the same, more or less, I give unto my son David Cloyd my interest in two tracts of land held and claimed by Thomas and David Cloyd, to wit, one of six hundred and eighty acres and the other two hundred and seventy acres adjoining and below the above Tract, which is situate in the County of Merser on Cristan's fork of Brush Creek.
I give unto my son David Cloyd the following Negro slaves, to wit, Moses and wife, Florah, and three of their sons: Allen, Westley, Stephen and wife Mariah and son Henry. Also, Stumpy, Jim, and his wife Susannah and five children, to wit, Edward, Elisa, Margart, Luanna and Felix. Also Isaac, and his wife Lynda and three children, to wit, Luisa, Caroline and William. Also the following children of a Man, Charles, by his first wife, to wit, Abram, Mathus, Lucy and Joseph. Also Big Edward. Also Big Jim. Also Daniel. Also Hannah and two of her children, to wit, Sampson and Mima. Also Nancy and five of her children, to wit, Rachel, Samuel, Tom, Herod, and Ellen.
I give unto my son David Cloyd all my stock of cattle and horses and hogs and sheep that is now on the Dunkard bottom and Egypt, and including a flock of sheep that is now at Cecil place. Also all of my guns and all of my farming utensils.
I give unto my son-in-law, Gordan Kent, who married my daughter Lucinda Cloyd, the following tracts or parcels of land situate in the said County of Pulaski, on the waters of Neok Creek and falling Spring, waters of New River, to wit, Cecil Place, four hundred and forty-three acres. Also thirty-six acres adjoining the same on the North and East sides. Also fourteen acres adjoining said 443 acres and James Hoge. Also one thousand and four hundred and ninety-six acres, part of a patent granted to Joseph Cloyd for 300 acres. Also two hundred and sixty-two acres in two parcels that was devided to the said Thomas Cloyd by Peter Bish and George Gordan and amounting in the whole to about two thousand two hundred and fifty-one acres, be the same more or less, which include the following plantations, to wit, Cecil place, Morgan place, the Bish place and the place now occupied by Thomas Bratton on Pepers road, together with the fixtures and appurtenances thereunto belonging on said plantations.
I also give unto my son-in-law Gordan Kent all my stock of cattle that is now at Cecil and Morgan places amounting in the whole to about thirty-five or forty head. Also my stock of hogs that is now on Cecil or Morgan places. Also any farming utensils I may have at of two tracts of land situate in the County of Montgomery on the waters of the North fork of Roan Oke, which was patented to Thomas and David Cloyd, one of which is one thousand and one hundred and sixty acres, the other five hundred and seventy acres, adjoining above on the North side thereof.
I give unto my son-in-law Gordan Kent the following Negro slaves, to wit, Nathaniel and wife Esther and five children, to wit, John, Martha, Jacob, Ames, and Hariet, also Charles and wife Emmerly, and her child, Martha, and Charles' son, Andy, by his first wife. Also Seyntha and her son Frank. Also Mary, a daughter of Nancy's. Also Zachariah a son of Moses.
Having now closed my affairs and made a disposition of my property, I hereby direct my Executors to make no sale of any of my property as I owe no debt of any magnitude and would select the Worshipfull court of Pulaski to ask no security of my Executors, and should they manage the affairs of my estate badly it will be their own loss and not the public's.
I do hereby constitute and appoint my son David Cloyd and my son-in-law Gordan Kent my Executors with full power and authority to act as such, given under my hand and seal this 30th day of January 1842.

Codocil the 1st. I make the following addition to my will of the 30th day of January last and is annexed to this paper which is as follows: I give to my son David Cloyd all the ready money I may have at my death. Also all the Bonds or Accounts I may leave unpaid, given under my hand and Seal this 15th day of February 1842.

At a Court held for the County of Pulaski the 4th day of October 1849. The last Will and Testament of Thomas Cloyd deceased was presented in Court proven by the oaths of Jabon B. Alexander and James L. Yost subscribing witness thereto, and the Codicil was proven by L. A. Cunin and the hand writing of the Codicil was proven by Robert M. Craig and the same was ordered to be recorded. And on the motion of David Cloyd one of the Executors named therein who made oath thereto entered into and acknowledged a Bond in the penalty of $20,000 with conditions according to law certificates is granted him for obtaining a probate thereof in due form. Security in the Bond being dispensed with by the Court according to the request of the Testator.
