Took the Oath of Fidelity at Eastham on Oct 25, 1667. Sued Stephen Merrick for unlawfully taking a horse on 10/25/1668. The next year he appeared in the Plymouth Colony Court to answer suits brought against him. Samuel served as Constable of Eastham in 1670 and the next year was sued by Joseph Harding for abuse of his duties in that position. On 7/7/1682 Thomas Clarke Sr. of Plymouth sued Samuel Smith of Eastham for unjustly detaining profits of a Cape Cod fishing venture. On the first Tuesday in Oct 1686, Samuel Smith and John Mayo were charged with netting mackerel at Cape Cod in violation of a court order.

Substantial landowner in several locations.

    Mary Hopkins, d/o Gyles Hopkins and granddaughter of Stephen Hopkins, m. Eastham 3 Jan 1665 to Samuel Smith and had 7 children at Eastham. One son died unnamed; Joseph, Grace, and Rebecca died without issue; Samuel, Jr. died before his parents (22 Sep 1692) but left widow Bathshua (Lothrop) Smith and two sons Samuel and Joseph; John and Mary, the latter being the wife of Daniel Hamilton, survived their parents. The inventory of Samuel Smith, Sr.'s estate was taken 6 Apr 1697, and administration was granted to his widow Mary and son John on 20 Apr 1697. Samuel, Sr.'s widow Mary Smith died 2 Jul 1700.

    Indications are that Grace (Ralph Smith's widow) was not the mother of his children, which included Samuel, bp. July 11, 1641. 27 Oct 1685, administration of the estate of Ralph Smith's estate granted "to Grace Smith, the relict of Ralph Smith, and Samuell Smith, son to the s'd Ralph Smith, all of the town of Eastham".
