Will Transcript

Samuel Ewing's Will
I Samuel Ewing of the County of Russell in the State of Virginia being of sound mind and disposing mind and memory do make this my last Will and Testament in the manner following:
I give bequeath to my daughter Margaret Ewing the sum of one thousand dollars to be paid to her by my executors in three equal annual installments the first of which is to be paid one year after my decease.
I give and bequeath to my son Joshua Ewing one hundred and fifty four acres of land adjoining the tract this day conveyed by me to him in Elk Garden, as also negro boy between the age of twelve and fifteen years which is to be purchased by my executors out of the proceeds of my estate for him.
I give and bequeath to my daughter Jane the tract of land on which I now live in the County of Russell containing about two hundred acres during here life after the death of her husband Oliver Hughes should she survive him, and not before, and after her decease, I give and bequeath the same to my grand daughter Sally Ewing Hughes ~ during the life of said Oliver Hughes and previous to the death of his present wife, I further direct that the said tract of land be rented out by my executors and that the profit thereof be equally divided between the said Sally Ewing Hughes and my grand daughter Sally Ewing, daughter of my son Samuel Ewing.
I give and bequeath to my daughter Nancy Hays my tract of land in the county of Russell which I purchased of Drury Woods as also my two slaves Ben and Dine?.
I also direct that my executors purchase a horse and furnish the said slaves with money enough to bear their expenses to the state of Kentucky to the residence of my said daughter ~ the horse so to be purchased to be of the value of fifty dollars.
I give and bequeath to my Son Samuel One dollar only to be paid to him by my executors, and recommend him to the bounty of my other devisees as his necessities may require.
I direct that my slave Cato be sold by my executors, but not without permitting him to make choice of a master.
I direct that 7,291 acres of land or thereabout conveyed to me by Joseph Scott, Marshall of the district of Virginia by seven separate deeds of conveyance be equally divided between my children aforesaid except my son Samuel whose children is to have the portion of one of my other children and he is excluded.
I direct that all my personal estate of every description be sold by my executors on the usual credit and after the payment of all my Just debts and funeral expenses.
I further direct that all the residue of my estate not herein specifically devised be equally divided between my children above named, except my son Samuel who is excluded from any part in the residueum of my estate.
I hereby constitute ordain and appoint my friends Robert Craig Senr. of the County of Washington, Andrew Russell of the same County and Col.o John Tate of the County of Russell executors of this my last Will and Testament revoking all former wills and declaring this only to be my last will & Testament.
In witness whereof I have hereunto set my hand and seal this twentieth day of February in the year one thousand eight hundred and fifteen.

This instrument of writing was exhibited in Court as and for the last Will and testament of Samuel Ewing dec'd and proven by the oath of Henry Parrott one of the subscribing witnesses thereto, and, ordered to be recorded to record as to the personal estate therein mentioned and the executors therein named refusing to take upon themselves the burthen of the execution of the said Will. On motion of Oliver Hughes and Thomas Dickenson who made oath as the law directs and entered into bond in the penalty of four thousand dollars with Henry Dickenson Senr. and James Dickenson Senr. their securities conditioned according to law Certificate is granted the said Oliver V. Thomas [s/b Hughes?] for obtaining administration of the said decedents estate with the Will annexed in due form.

    V. Samuel Ewing b ca 1740/41 d 1817 in Russell Co., Virginia. It has been said that this man married 3 times but we have failed
    to find the name of any wife on any of the Deeds he executed. We do know things about him that several genealogies have
    mistakenly recorded. A debt of gratitude goes to Mrs. Glenn Ewing McCoy Turnell, who, in THE COLONIAL GENEALOGIST,
    Volume VI #1, Winter 1971 set the record straight on the above Samuel Ewing. She quotes deeds that Reid Ewing and I had
    from Cecil Co., MD and deeds from Washington, Co., Va and Russell Co., Va. that we had not accessed. (She corrected the
    information in E.W.R. Ewing’s CLAN EWING OF SCOTLAND pages 188-90 and of Col. Wm. A. Ewing page 42) Below is the
    correct family of this man. As we saw, he and his brother, Nathaniel Ewing inherited DIVIDING from their father, Joshua Ewing
    in 1753, in Cecil Co., Maryland.
    • Cecil Co., Deed 11 page 417 dated 31 May 1769 states that “Samuel Ewing purchased 300 acres for £350 part of the tract called
    DIVIDING from Nathaniel Ewing, William Ewing, Patrick Ewing, and Robert Ewing.

    We still do not understand the changes in the ownership of this one piece of land that William Ewing had inherited by primogeniture
    and that the two, Nathaniel and Samuel, had been willed by their father. The following earlier deed reads:
    • Cecil Co,, MD Deed Book 10 page 371 “William Ewing eldest son of Nathaniel Ewing, deceased, and his widow, Rachel Ewing,
    from Patrick Ewing, eldest son of Joshua Ewing deceased, and his widow, Jane Ewing, and Robert Ewing and Samuel
    Ewing, and Nathaniel Ewing part of DIVIDING located on the North Side of the Octoraro Creek, for 5 shillings.” But, the
    following proves what Samuel Ewing did with his part:
    • Cecil Co., MD Deed Book 16 page 181 dated 4 October 1787, Samuel Ewing sold to James Miller of Philadelphia, PA 200acres,
    his part of DIVIDING for £l,000. He is of Russell Co., Va.(which was formed in 1786 from Washington Co., VA.) The
    following Deed identifies him further:
    • Cecil Co., MD Bill of Sale Book 17 page 94 dated 11 Nov 1790 “Samuel Ewing, of Russell Co., Va. sells to John McCoy of
    Cecil Co., MD a negro named Peter he purchased from Col. Elihu Hall. Witnesses were Patrick Ewing and Thomas
    Johnson. Court records and Deeds further identify this man in Russell Co., Va. and the settlement of his estate names
    grandchildren. In Maryland Revolutionary War Records he is listed as Paymaster of the 2 Maryland Regiment of Col.nd
    Thomas price from 9 May 1777 to 2 January 1778. One Samuel Ewing is listed as a deserter but many records were
    incorrect at the close of the War. Samuel Ewing's will is found in Russell Co., Va.
    Will Book #3, page 208 dated 20 Feb. 1815 and probated 3 Nov 1817.
