Will of Real and Personal Estate. In the name of God Amen: I Peter Swart of the town of Davenport in the County of Delaware and State of New York, of the age of seventy seven years and being of sound mind and memory, do make publish and declare this my last will and testament in manner following that is to say First I give and bequeath to my two daughters Mariah and Lavancha, the sum of one hundred dollars each and to my son Shelden Swart, the sum of fifty dollars, which said several legacies or sums of money I direct and order to be paid to the said respective legatees within one year after my decease. Second.-- I give and devise to my two sons Isaac and Hiram Swart all that tract or parcel of land situate in the town of Davenport, County of Delaware and State of New York containing fifty eight acres and being the same farm and premises I now own and occupy. Together with all the hereditaments and appurtenances thereunto belonging or in any wise appertaining to have and to hold the premises above described to the said Isaac and Hiram their heirs or assigns forever. Third: I give and bequeath all of my Personal property, estate goods and chattels of what nature or kind so ever to my two sons Isaac and Hiram aforesaid to be divided equally between them share and share alike in all my Real and Personal Estate. Lastly I hereby appoint Henry Orr Sole Executor of this my last will and testament hereby revoking all former wills by my made. In witness whereof I have hereunto set my hand and seal this 5th day of August in the year of our Lord One thousand eight hundred and sixty five. his mark Peter Swart.
