Proved, 20th September, 1796, by Berry and Kenan. Tate refuses to execute, also McPheeters. Sarah refuses to administrate. Administration granted John Tate, Jacob Kinney.

Wife, Sarah, and her children, land in Harrison County on the Monongahela; daughters, Elizabeth Luce, Mary Stockdale; daughter, Hannah Halsey; sons, James Hayes, Isaac Hayes, Richard Hayes; sons, Winsted Hayes, William Hayes. Dated 21st July, 1796. Proved in Augusta, 20th September, 1796. Bill filed 29th March, 1813, by William Hayes of Pendleton County. Moses Hays left 5 children besides orator, viz: George, Susanna Hardiway, wife of John Hardiway; Nancy, now wife of Henry Cunningham; Sarah, now wife of John Gaul; and Peggy. Signature of Squire Boone, 1783. Letter by William Clendennin dated Greenbrier, 15th May, 1782, the Indians have been very troublesome this spring; is brother of George Clendennin, member, and now attending the Assembly. Signatures of, viz: Wm. Spriggate, 1786; Wm. Gamson (Jemmyson), 1793.

• 1. Elizabeth 'Betsy' HAYS was born about 1761 in Augusta Co, VA. Some sources have her born in Rochingham Co, VA. She died about 1819 in Concord Twp, Champaign, OH. She was buried in Talbert Cemetery near Urbana, OH. She was married to John LUCE (son of Benjamin LUCE and Elizabeth HOPKINS) about 1782 in Augusta Co, VA. Some sources have her married in Rochingham Co, VA. John LUCE was born in May 1764 in Roxbury, Morris, NJ. He died about 1823 in Concord Twp, Champaign, OH. He was buried in Talbert Cemetery near Urbana, OH. Note: John LUCE is # 1-5-3-3-4 in the book "The American Descendants of Henry Luce of Martha's Vineyard, 1640- 1995" by Martha F. McCourt.
• 2. Mary HAYS was born on 25 Dec 1761 in VA. She died. May have died in IN? She was married to Jesse STOCKTON (son of Samuel STOCKTON and Prudence TORBET) in 1783 in Fredericksville Parish, Albemarle Co, VA. Jesse STOCKTON was born on 4 Sep 1755 in Amherst Co, VA. • 3. Hannah HAYS. She was married to HALSEY in VA?.

He was married to Mary 'Molly' BUSTER (daughter of Claudius BUSTER Sr. and Dorcas Sumpter FRANKLIN) on 1 Jan 1782 in Albemarle Co, VA. Mary 'Molly' BUSTER was born about 1765 in Ivy, Albemarle, VA. S. 74-Patent by Dunmore, 20th June, 1772, to Thomas Walker, for 800 acres in Augusta, between Beverley Manor and South Mountain, cor. Lazarus Inman, John Campbell, Wm. Teas. Deed 30th October, 1801, by James Flack and Mary, his wife to James Hayes of Albemarle. Tract purchased from Jane Allen. Deed 30th October, 1801, by same to Jacob Baumgardner and Isaac Hayes; part of tract purchased from Jane Allen. Will of James Hayes of Albemarle: Nine children, viz: James, David, Isaac, Nathaniel, Thomas, William, Mary, Sarah Ann, Malinda. Son John and daughter Elizabeth married to Roberts Brooks. Dated 6th December 1812, and recorded by the Circuit Court 13th May 1813. (Chalkey).

3. Judgements: Brooks and wife vs Hay's executors-O. S. 245; N. S. 86-Bill, 1814. Complaints are Robert Brooks and Elizabeth, late Hays; David, William, Isaac and Thomas Hays, infants, part of children of James Hays, deceased, of Albemarle, who died 11th December, 1812, leaving widow and additional children, viz: James Hays; and minors, viz: Nathaniel, Mary, Sarah Ann, Malinda Hays. Charge is that James, Sr., had become imbecile through drink and James, Jr., induced him to make a will. Jaconia Yancey was uncle of wife of James, Jr. Signature.....Wm. Gamson (Jemmyson), 1793. 7. August Co. Kinney vs Hays Chancery bk 16, pg 244 shows that Isaac Hays who m. Mary Mitchell was the definite brother of the James Hays that married Mary Buster. Isaac, the brother of James, died @@ 1804 in the Indian Nation delivering the mail. This case mentions Isaac had children Elizabeth, James, and Mary. Claudius Buster was the administrator.
