Will Transcript
- I, Michael Ochiltree, of Botetourt Co., and state of Virginia, sensible of the uncertainty of this mortal life, and being of sound mind and memory, do make this my last will and Testament, in manner and form following: and first, that my remains be decently interred; and secondly, that the tract of land on which I now live, containing 600 acres, more or less, be sold; the one half of its value, when sold, a young sorrel mare, together with one bed, and its furniture, and cupboard furniture, I give and bequeath to my beloved wife, Elizabeth Ochiltree. Thirdly, that entrays (tracts) adjoining the above mentioned tract, together with a small tract in the Valley, Rockbridge Co., with all my personal estate, be sold; after twenty pounds, given to the Rev. William Baldridge, all my lawful debts paid, the balance to be equally divided, between my brothers and sisters; or in case of death, their heirs.
- And further, I appoint William Finley and John Robinson, of Rockbridge Co., to be the sole executors, of this, my last will; revoking all former wills.
- In witness whereof, I have, hereunto, set my hand and seal, this eleventh day of May, in the year of our Lord, one thousand, seven hundred and ninety-nine.

- The Last Will and Testament, of Michael Ochiltree, deceased, was exhibited in Court and proved, by the oath of James Hewitt, James Stone, and the affirmation of William Crop, witnesses thereto; subscribed and ordered to be recorded:

- Vol. 2 - Ochiltree vs. Ochiltree--O. S. 107; N. S. 36--Bill, 22d November, 1804. Orators are: Mathew Okletree (in his own right and as attorney-in-fact for James Okletree and Elizabeth Okletree, widow and administratrix of Robert M. Waugh, administrator of John Okletree, deceased). John Okletree, deceased, and James Okletree and orator are sons and representatives of Mathew Okletree, Sr., deceased. Mathew, Sr., had two other children, viz: Elizabeth and Thomas. Said Mathew was only brother to Michael Okletree, deceased, the testator of defendants. Michael had no sisters. Michal died testate, will dated 11th May, 1799. Michael Okletree's will of Botetourt County. Wife, Elizabeth; brothers and sisters. Proved in Botetourt, June 1799. Power of attorney by Elizabeth Ockeltree, widow and administratrix of John Ockeltree, late of White Clay Creek Hundred, and County of New Castle, Delaware, deceased, and Robert M. Waugh, administrator to Mathew Ockeltree, dated 23d May, 1803. Similar power of attorney by James Ockeltree of Mill Creek Hundred, New Castle County, Delaware, to Mathew Ockeltree of Cecil County, Maryland. Deposition in New Castle County, Delaware, that Mathew and Michael Ockeltree were brothers. Mathew had five children, Elizabeth, James, John, Mathew and Thomas, all alive in 1803, except John, who died December, 1802, leaving Elizabeth, widow, and six children.

Cartmill's Company, viz: David Wallace, John Henry, Michael Ocheltree, Christopher Hurst, Samuel Woods, John Wingfield, Wm. Baston, Henry Baston, William Sutton, Henry Cartmill, Thomas Suvill, Patrick Dunn, Jas. McCarrell, Thomas Harrison, be considered as the Thirty-fourth District. From "History of the house of Ochiltree of Ayrshire, Scotland : with the genealogy of the families of those who came to America and of some of the allied families", by Clementine Brown Railey, pg. 5:
- Michael Ochiltree, evidently, according to deposition, in the case, Ochiltree vs. Ochiltree, went from New Castle Co., Del., to Rockbridge Co., Va., between 1794 or '95 and 1797, as the deponent knew him in New Castle Co., four or five years before his death, in 1799, and he bought land in Rockbridge Co., Va., in 1797. On Sept. 20, 1798, he married, evidently late in life in Rockbridge Co., Betsey Findley. Rev. William Baldridge officiating minister. He died in Botetourt Co., adoining Rockbridge Co., in May 1799. He left half of his estate to his wife, and one half to his brothers and sisters; in case of their death to their heirs. It is evident, from this, that Matthew, Michael and Alexander Ochiltree had sisters, although the nephews were not aware of the fact. His brother, Alexander, was killed by the Indians in Greenbrier Co., Va., in 1778, and his brother Matthew had died, in New Castle Co., Del., the year previous to his death.
