    7. This deed made this thirteenth day of October in the year 1923 between Walter W. Moyer of the city of Reading, county of Berks and the state of Pennsylvania and Ella C. his wife of the first part (herein after called grantors) and LUTHER W FRIEND and EVA FRIEND, husband and wife of the Borough of Ephrata, County of Lancaster and state aforesaid of the other part (herein after called the grantee) Witnesseth that in consideration of $4800.00 dollars in hand paid the receipt whereof is hereby acknowledged the said grantors do hereby grant and convey to the said grantee heirs and assigns all that certain lot or piece of land with a brick and stucco dwelling erected thereon situate in the Borough of Ephrata, Lancaster County, Pa. Bounded and described as follows:
      Beginning at a point in West Main Street, a corner of land of Adelaide S. Newcomb thence North twenty eight and one half degrees, East on hundred fifty two feet more or less to a point in the Middle of the Cocalico Creek, thence down the middle of the same, the several course and distances twenty five feet more of less to a point in the said creek (Parallel to the middle of partition wall of the adjoining dwelling which shall be taken as the Western boundary line of the adjoining property), a corner of land of said first party hereto of which this grant is a part thereof thence by land of the same South twenty eight and on half degrees West one hundred and hundred two feet more or less through middle of partition wall of adjoining dwelling to a point in said West Main Street, thence along in said Street South sixty two degrees , East twenty four feet more or less to a point and place of Beginning containing eleven and thirteen thirtieth Perches more or less.
      It being a part of the same premises that Adelaide S. Newcomb and Everett H Newcomb, her husband, by their deed duly executed dated the 3rd day of March 1923 did grant and confirm the same unto the said Walter W Moyer, his heirs and assigns recorded in the Recorders Office of Lancaster County in Deed Book U Vol. 25, Page 138 as in and by the said in part recited deed or its record thereof will more fully appeared subject and charging the premises hereby conveyed to the owners or owners thereof forever that the said Walter W Moyer for himself, his heirs and assigns, reserves flood water rights on and of land to a point at highest flood water mark on the rear of the herein described property, and the cess pool on the land line in rear of the adjoining dwelling of the herein described premises to be for the benefit and joint use of the two adjoining properties and the repairs of its maintenance to be equally divided between the adjoining property owners, there heirs and assigns, and that the original color on the dwelling shall be maintained viz:
      Wood finish in white, brick color and stucco and that the said colors may be changed only by mutual agreement in writing between the adjoining property owner, their heirs and assigns. The said grantors do covenant themselves that they will be these present forever defend and warrant him the property hereby conveyed in witness whereof said grantors has hereunto set their hands and seals, day and year, first above written, sealed and delivered, in the presents of us.
    8. 351 West Main Street. This census lists Luther as head of household. He was thirty one years old and had married Eva at the age of nineteen. He was the father of one child, Evelyn (9). His occupation was listed as Knitter at Underwear mill. They owned their own house, which was listed as worth $4800.00. They also had a radio. He could read, write, and speak english.
    9. This deed made this twenty first day of July, in the year nineteen hundred and forty one. Between Luther W Friend and Eva H. Friend, his wife, of the township of East Cocalico, County of Lancaster and State of Pennsylvania, parties of the first part, hereinafter called the Grantors and Mildred C. Gier, of the Borough of Ephrata, County and State aforesaid, party of the Second part, hereinafter called the Grantee.
      Witnesseth, That in consideration of the sum of thirty four hundred dollars, in hand paid, the receipt whereof is hereby acknowledged, the said Grantors do hereby grant and convey to the said Grantee her heirs and assigns.
      All that certain lot or piece of land with a brick and stucco dwelling erected thereon situate in the Borough of Ephrata, Lancaster County, Pa, Bounded and described as follows: Beginning at a point in West Main Street, a corner of land now or late of Adelaide S. Newcomb; thence north twenty eight and one half degrees east, one hundred and fifty two feet, more or less to a point in the middle of the Cocalico Creek; thence down the middle of the same the several courses and distances, twenty five feet, more or less, to a point in said creek (parallel to the middle of partition wall of the adjoining dwelling, which shall be taken as the western boundary line of the adjoining property, a corner of land now or late of Walter W. Moyer; thence by land of the same, couth twenty eight and one half degrees west, one hundred and forty two feet, more or less, through middle of partition wall of adjoining dwelling to a point in said west Main Street; thence along in said street south sixty two degrees east, twenty four feet, more or less, to a point and place of beginning. Containing eleven and thirteen thirteen perches, more or less.
      Being the same premises which Walter W. Moyer and Ella C. Moyer, his wife, by their deed dated October 13, 1923, and recorded in the office for the Recording of Deeds in and for Lancaster County in Deed Book K, Volume 26, at Page 508, conveyed unto Luther W. Friend and Eva H. Friend, his wife, under and subject to the same conditions, covenants, obligations, and restrictions as are set forth in the Deed form Walter W. Moyer and Ella C. Moyer, his wife, dated October 13,1923, and recorded in the Recorders office aforesaid in Deed Book K, Volume 26, at page 508. The said Grantors covenant that they will warrant specially the property hereby conveyed.
      In witness whereof, said Grantors have hereunto set their hands and seals the day and year first above written.

      On this twenty first day of July, A.D. 1941, before me the subscriber a Notary Public, in and for said State and County, came the above named Luther W. Friend and Eva H. Friend, his wife, and acknowledged the foregoing Deed to be their act and deed and desired the same to be recorded as such. Witness my hand and notary seal the day and year aforesaid. My commission expires February 2, 1943. Arthur M. Yeager, Notary Public.
    10. This Deed made the 30th day of April, in the year nineteen hundred and fifty six. Between Luther Friend and Eva Friend, husband and wife, of the township of East Cocalico, County of Lancaster and Commonwealth of Pennsylvania, Grantors herein, and Donald F. Johnson and Marjorie W. Johnson, husband and wife, as tenants be the entireties, of the township of East Cocalico, County of Lancaster and Commonwealth of Pennsylvania, Grantee.
      Witnesseth, that in consideration of Seven thousand nine hundred dallors ($7900), in hand paid, the receipt whereof is hereby achnowledged, the said grantors, do hereby grant and convey to the said grantees, their heirs and assigns.
      All that certain tract of land together with a two and a half story frame dwelling and frame out buildings erected thereon situate in the Township of East Cocalico, County of Lancaster and Commonwealth of Pennsylvania, Bounded and described as follows:
      Beginning at a sandstone in a public road; thence by lands now or late of Joseph Gelsinger South on and one half degrees East sixty six and four tenths perches to a stone near a hickory tree; thence by land now or late of the Jerome Moyer Estate North forty five and one half degrees East fourteen and on tenth perches to a stake, and north forty two and one half degrees East ten and nine tenths perches to a pin Oak; thence by other land now or late of the Jerome Moyer Estate North twenty on and three fourths degrees West twenty eight and four tenths perches to a stake and North three and one half degrees West nineteen perches to a stone in a public road leading to Black Horse Hotel; thence by land now or late of John Wann and in and along said public road South eighty nine and one half degrees West ten and eight tenths perches to the place of Beginning.
      Containing five acres and on hundred and twenty perches more or less.
      Being the same premises which Ada Prussman, Widow, by ger deed dated September 23, 1936 and recorded in the Recorder's Office in and for Lancaster County in Deed Book T, Volume 32 at page 187 granted and conveyed unto Luther Friend and Eva Friend, Grantors herein, their heir and assigns.
      And the said grantors, do hereby warrant specially the property hereby conveyed, in witness whereof, said grantors have hereunto set their hands and seals the day and year first above written.
      Commonwealth of Pennsylvania, County of Lancaster SS:
      On this, the 30th day of April 1956, before me a Notary Public the undersigned officer, personally appeared Luther Friend and Eva Friend, husband and wife, Grantors herein, known to me to be the persons whose names subscribed to the within instrument, and achnowledged that they executed the same for the purpose therein contained.
    11. This deed, made the 2nd day of May nineteen hundred and fifty six between Melvin H Neff and Carolyn D. Neff, husband and wife, of the Borough of Ephrata, County of Lancaster, Commonwealth of Pennsylvania, the Grantor herein, and Luther W. Friend and Eva H. Friend, husband and wife, of the Township of East Cocalico, County of Lancaster, Commonwealth of Pennsylvania, the Grantees herein.
      Witness, that in consideration of thirteen thousand five hundred dallors ($13,500), in hand paid, the receipt whereof is hereby achnowledged, the said grantors do hereby grant and convey to the said grantees, their heirs and assigns, as tenents by entireties.
      All that certain tract of land with the brick dwelling and improvements thereon erected, being known as No. 109 Penn Avenue, on the East side of Penn Avenue in Arlingtonville, a suburb of the Borough of Ephrata, Lancaster County, Pennsylvania, Being Lot No. 418, 419, five feet of Lot No. 417 and ten feet of Lot No. 420 on the plan of Lots as laid out by the Arlington Real Estate Company in April, 1912, said Plan being recorded in the Office for the Recorder of Deeds in and for Lancaster County, Pennsylvania, bounded and described as follows, to wit:
      Beginning at the Southwest corner thereof at an iron pin on the building line on the East side of Penn Avenue, said iron pin being fifty five feet, measured along the arc of a circle, from another iron pin set at the point of intersection of said building line on the East side of Penn Avenue with the building line of the North side of First Street; thence along the building line on the East side of Penn Avenue in a Northeast direction, by a line curving to the left being the arc of a circle baving a raduis of eight hundred one and ninety seven hundredths feet, a distance along the arc of fifty five feet to an iron pin; thence leaving said Penn Avenue in a Southeast direction, a distance of one hundred seventy five feet to an iron pin on the West side of a twenty feet wide alley; thence along the West side of said alley in a Southwest direction by a line surving to the right being the arc of a curcle having a radius of nine hundred seventy six and ninety seven hundredths feet, a distance along the arc of a sixty seven and seventy five hundredths feet to an iron pin, said iron pin being sixty eight and seventy five hundredths feet measured along the arc of a circle from another iron pin set on the building line on the North side of First Street, where it intersects with the West side of said alley; thence leaving said alley in a Northwest direction, a distance of one hundred seventy five feet to the place of Beginning. Containing thirty nine and four tenths perches.
      Being the same premises which Lenton W. Sweigart and Alice B. Sweigart, by their Deed dated January 13, 1953, and recorded in the Recorder of Deeds Office in and for the County of Lancaster in Deed Book Q, Volume 42, at page 168, granted and convey unto Melvin H. Neff, one of grantors herein.
      Under and subject that no building or structures of any kind or character shall be erected or built upon any of the hereinbefore described lots within a distance of twenty feet from the building line of Penn Avenue.
      And the said grantors do hereby warrant speically the property hereby convey.
      In witness whereof, said grantors have hereunto set their hands and seals the day and year first above written.
    12. I, Luther W. Friend, of the Borough of Ephrata, Lancaster County, Pennsylvania, being of sound mind, memory and understanding, do make and publish this my last will and testament, hereby revoking any and all wills and codicils by me at any time heretofore made.
      First: I order and direct my hereinafter named Executrix to pay all my just debts and funeral expences as soon after my decease as can conveniently be done.
      Second: All the rest, residue and remainder of my estate, real, personal and mixed, of whatsoever nature and kind and wheresoever situate, I give, devise and bequeath unto my wife, Eva H. Friend, absolutely.
      Third: In the event that my said wife, Eva H. Friend, should precease me, or her death should occur simultaneously with mine, then and in that event, all the rest, residue and remainder of my estate, real, personal and mixed, of whatsoever nature and kind and wheresoever situate, I give, devise and bequeath unto my daughter, Evelyn C. Sachs, absolutely.
      Lastly: I nominate, consitute and appoint my wife, Eva H. Friend, Executrix of this my last will and testament. In the event that my wife, Eva H. Friend, should predecease me or become incapacitated, then I nominate, constitute and appoint my daughter, Evelyn C. Sachs, to be the Executrix of this my last will and testament. I further order and direct that J. Marlin Shreiner, Esquire, of Ephrata, Pennsylvania, be employed as counsel in the settlement of my estate.
      In witness whereof, I have hereunto set my hand and seal this 5th day of December, A.D. 1958.

Friend, as and for his last will and testament, in the presence of us who, at his request and in his presence of us who, at his request and in his presence, and in the presence of each other, have hereunto subscribed our names as witnesses thereto.
    13. Retired from this company with fifty years of service. They awarded his service with a United States Government "H" Bond in the amount of $500.00.
    14. Luther Washington Friend, 80, of 109 Penn Ave., Ephrata, died Friday at 3:15 p.m. in the Ephrata Community Hospital following an illness of several weeks. He was the husband of the late Eva Keller Friend, who died June 21, 1977. Born in Ephrata, he was a son of the late John A. and Emma Bingeman Friend. He was employed for over 50 years as a knitter fixer for the W. W. Moyer Co., and retired in 1964. He was a member of the 25-year club of the W. W. Moyer Co., and the Trinity Lutheran Church, Ephrata. One daughter, Evelyn C., wife of Frank W. Sachs, Ephrata, survives, along with on granddaughter and two great-grandchildren. Also surviving are a sister, Kathryn, wife of Karl Kehrweider, New Smyrna Beach, Fla., and a brother, John Friend, Chatham, Va.
    15. In the matter of the Last Will of Luther W. Friend, late of Ephrata.
      To the Register of Wills of Lancaster County, Pennsylvania:
      The petition of Evelyn C. Sachs, 356 W. Main Street, Ephrata, Pa, respectfully represents that She is the Executrix named in the last Will of the above named decedent dated December 5, 1958.
      That said decedent was a citizen of the United States, domiciled in Lancaster County, Pennsylvania, with last family or principle residence at 109 Penn Avenue, Ephrata, Pa, and died at Ephrata Community Hospital in the County of Lancaster and state of Pennsylvania on Friday the 13th day of April, 1979 at 3:15 o'clock P.M., aged 80 years, leaving no spouse surviving;
      The said decedent was not married since the execution of said will and had no child born or adopted since the execution thereof; and that said decedent was possessed of personal property of the estimated value of $300 dollars and of no real estate of the estimated value.
      Eve Helena Friend died June 21, 1977
      Therefore Petitioner respectfully applies for probate of said Will and for Letters Testamentary thereon, this 2nd day of May 1979.
