[edit] Fathers's WillJoseph's father James Patterson, wrote a will on either 26 February 1790, or 26 February, 1793. Chalkley provides two separate transcriptions of the will of James Patterson, father of Joseph (34), based on their recordation in two separate locations in Augusta court records. He notes that the version on 3:233 was recorded in 1809 in Augusta after it was proven by by deposition of Robert Young, taken in Montgomery County, Ohio, corporation of Dayton, before William McClure, president of the corporation, 13th August, 1808. Page 150.--26th February, 1793. James Patterson's will--To sons, Joseph and Mathew; daughter, Elizabeth Gray; to granddaughter, Elin Henderson, daughter to Archibald Henderson; to Ellin Dickey, her grandmother's chest; to daughter, Isbald Dickey (legacy to Isbold Dickey provided Jno. Hickey provide a slave in lieu); to son Joseph's sons, Joseph and James. Executors, Jno. Dickey, Jno. Bell. Teste: James Young, Francis Brown, Robert Young. Proved, 29th September, 1807. Executors qualify. Page 269.--26th February, 1790. James Patterson's will, far advanced in years--To sons, Joseph and Mathew; daughter, Elizabeth Gray; to granddaughter, Elin Henderson, daughter to Archibald Henderson. (This will recorded p. 150, supra recorded there as to personal estate. Now, 26th April, 1809, proved by deposition of Robert Young, taken in Montgomery County, Ohio, corporation of Dayton, before William McClure, president of the corporation, 13th August, 1808. It is not clear why the will is given two different dates. The fact that the day of the month for both is 26 February suggests that a transcription error has been made, presumably by Chalkley. Alternatively, the error may have been made during the original recordation. The abstract version of the will dated 1793 contains more information. It seems likely that the differences (apart from the date), are due to differences in Chalkley's extraction of information, but perhaps the differences lie within the original court records. Overall, it would be useful to examine the original court records to see how they compare with each other, and with the two versions presented by CHalkley. In the 1790 version of the will James describes himself as "well advanced in years". The will identifies two sons and two daughters, though there may have been a third daughter, depending on how one interprets the reference to "Ellin Dickey". James identifies the relationship between himself and all of the other legatees, stipulating, son, daughter, granddaughter, etc. He does not give Ellin Dickey's relationship. She coud be a married daughter, or perhaps a married grandaughter. Based on these relationships, at a minimum, he could have been born no later than c1752 (1790-20-4*8). That would have made him 48 at the time he wrote his will, which wuold seem to be much too young to describe himself as "well advanced in years". its quite possible that Ellen Dickey is the daughter of either ELizabeth=Gray, or Ellin =Henderson, and herself married to a Dickey. This would add about 20 years to James latest possible DOB, making it c1732. This assumes that all descendants were at least 20 years of age at marriage. If an earlier DOM (say, age 15) is assumed, then an earliest DOB of c1742 results. James will was proven in 1807 per the 1793 version of the will. That gives a DOD between 1790 (earliest version of will) and 1808. if he died in 1807, we get an age at death of perhaps 75, an age wholly consistent with his self identification of "well advanced in years".
