Joseph's age at death comes from his gravestone. "In memory of Capt Joseph Bartlett who departed this life July ye 13th 1756 in ye 64th year of his age."

The will of Joseph Bartlett of Plymouth, gentleman, dated 4 Sept 1756 (sic), proved 3 July 1756, names wife Elizabeth; sons Silvanus and Zacheus Bartlett; dau. Jerusha Crosswell, wife of Joseph Crosswell; dau. Lydia Parker, wife of Jonathan Parker; dau. Elizabeth Rider, wife of Benjamin Ryder Jr. There is no Plymouth Co. Probate Record for Elizabeth Bartlett.

Captain Joseph Bartlett's Will


In the Name of God Amen:

I Joseph Bartlett of Plimoth in the County of Plimouth, Gentleman, living in barable Health and of a sound mind (Blessed be God for it) do make my Last Will and Testament as follows Viz:

I Recommand my soul to God that gave it humbly hoping for salvation thro the merits of Jesus Christ the Savior of Mankind and my body to a decent Christian buriall at the discretion of my executors hereafter named. And as touching the Estate God has blessed me with I dispose of the same as follows viz:

I give to my beloved wife Elizabeth Bartlett (in Lieu of her Dower of my Estate) all the monies Indoor movables & Provisions which I may be posessed of at the time of my death my negro girl named Violett and my chare horse and railing chair to hold to her and her heirs & assigns forever.

I likewise give my said wife the use and improvement of the front Westerly Room in my now Dwelling House the Chamber and Garret Over the said room and the entry & stone way in the front of the said house and a previledge in the seller under the same, and the kitchen pantry and sink room in the same house as shall be convenient for her and the use of one half of my chaise house and the use of one hyalf of my home barn during the term of her natural life or widowhood; I also give her a sufficiency of fire wood cutt, split for the fire & brought to said house during the term aforsaid, and the produce of one quarter part of my farm to be yealded to her labor of change by my sons Silvanous & Zacheus in equall halves and to be Delivered her yearly and every year during her term,

I give to my son Silvanus Bartlett and to his heirs and assigns forever all that tract of land lying at Monument Pond in said Plimouth known by the name of Warren's Lott which I purchased of my brother Benjamin Bartlett, Elnathan Bartlett & Phebe Barnes at several times and two thirds of my pasture called the Point Pasture, likewise all that my Seage ground near Beefhill in said Plimouth and my lott of Cedarswamp lying in Plimton which I purchased of John Carver always providing and upon condition that the said Silvanus and his heirs and assigns do pay and discharge one half of my just debts and funeral; charges, and yeald to his said mother one half of the said fire wood, and the One Half of the said Quarter of the Produce of the said Farm, as a love expressed and pay to my daughter Jerusha Cogswell and her heirs etc. what I shall herein devise to her, and to my daughter Elizabeth Ryder, and her heirs the one half of the sum of money which I shall herein bequeath her. I give to said Silvanus and to his heirs half the lott I bought of Isaac & Sarah Little near Sacrifice Brook in said Plimouth.

I give to my son Zackeus Bartlett & to his Heirs and assigns forever all my homestead with the buildings hereon standing except what I have herein disposed of, one third part of the aforesaid Point Pasture; all my meadow next the sea at said Monument Ponds, my wood lot at a place called Daniell's Hills, all my wood land ajoyning to said homestead and my cedar swamp in South medow cedarswamp which I purchased of Samuel Morton; always provided & upon condition that he or his heirs, executors, adm.rs or assigns pay and discharge one half of just debts and funeral charges and yeald to his said mother one half of the said fire wood and the one half of the said produce of the said farm as above expressed and pay to my daughter Lydia Parker and her heirs the same I shall herein bequeath to her, and to my daughter Elizabeth Rider & her heirs viz. the one half of the sum of money I shall herein bequeath to her. I give to my son Silvanus Bartlett to & for the seperate use and benifit of my daughter Jerusha Cropwell wife of Joseph Cropwell and to her heirs two cows, ten sheep and a yearling heifer. I likewise give to my sd son Silvanus for the same use seventy five pounds lawfull money, to be paid to her with lawful interest within three years after my death if she shall in his judgement need it for her and her childrens' support and in like manor as that none of it can be applied to the payment of her said husband's debts, or to his use any other ways than for the support of my said daughter and her children; I likewise give to my said daughter a dwelling in my Dwelling House in case she should be a widow.

I give to my daughter Lydia Parker, wife of Jonathan Parker, one cow, two yearling heifers and one sheep; I also give her the sum of Seventy five pounds lawfull money to paid to her or her heirs with lawfull interest by my son Zacheus within three years next after my decease.

I give to my daughter Elizabeth Rider, wife of Benjamin Rider Junr. one yoke of oxen, two cows, two, two year old heifers, two, two year old steers and nineteen sheep, I also give to her the sum of seventy five pounds lawfull money to be paid her or her heirs with lawful interest one half by my son Silvanas and the other half by my Zacheus in three years next after my decease. These legacies I give to my daughters over and above what I have heretofore given them.

I give all the rest of my estate Real & Personall to my said sons Silvanus & Zacheus and their heirs and assigns forever in equall halves and revoking all other wills: and in confirmation of this and making my said sons Executors hereof, I have hereunto sett my hand & seal Septr. the 4th Annoaque Domi 1756. Plymouth SS. July 23rd 1756. This will being presented for Probate by the executors therein named the said James Hovey, James Cartiss and John Cobb made oath that they saw the said Joseph Bartlett the testator sign, seal and deliver and heard him declare this instrument to be his last will and testament and that they at the same time sett to their hands as witness, and that he was then of sound & Disposing mind and memory according to the best of their judgement before me John Cushing Judge of Probate.

Province of the Massachusetts Bay Plimouth SS. (Seal) By the Honble John Cushing Esqr. Judge of the Probate of wills & for granting letters of administration on the estates of persons decd having goods chattles rights or credits in the county aforesaid

To all unto whom these presents shall come greeting Know ye that upon the day of the date hereof before me at Plimouth in the county aforsd the Will of Capt. Joseph Bartlett, late of Plimouth aforsd Gentleman decd. to these presents annexed was proved approved and allowed who having while he lived & at the time of his death goods, chattles, rights & credits in sd county aforsd & has Probate of ye sd will and Power of committing administration of all & singular the goods, chattles, rights and credits of the sd deceased by virtue thereof appertaining unto mr & administration of all and singular the goods chattles rights & credits of ye sd decd. and his will in any manner concerned is hereby committed unto his two sons Silvanus Bartlett & Zacheus Bartlett both of Plimouth Executors in ye same will named hold and faithfully to execute the sd will & to administer the estate of the sd decd according thereunto in testimony whereof I have hereunto sett my hand & the seal of the said Curt of Probate, Dated at Plymoth the 23rd day of July 1756.
