Know all men by these presents that wee the subscribers Beeing the children of the late Deceased our Honored father John Wheeler and meeting together with our mother at her House after the death of our father and finding that he had made disposall of All his Lands with the buildings thereupon by Deeds of Gift unto his three sons : yet not withstanding finding there was left considerable of moveable estate & that our Honored mother was well provided for by what was secured in our Brother Ebenezers hands during her life & for a Honorable buriall Did then agree with the consent and at the desire of our Honored mother to make devision of two thirds of the moveable estate amongst us with this provisall that wee do engage mutaly to pay all Debts that can legaly bee claimed from sd Estate the other third part our Honored mother is to enjoy as long as she living & it is Her will & pleasure that at her death Her thirds shall be equaly devided amongst her children the subscribers or their Heirs and the aboves'd Ebenezer Wheeler doth by these presents promise & engage that he will not ??? nor dispose of any part thereof namely of his mothers thirds but at his mothers death resign up what remaind[e]th to be devided amongst them except such things as are worn out : and as to our mothers waring cloths - as tis her Pleasure they should be eqaly devided amongst her five daughters or their children in case of their decease or any one of them so likewise the s'd Ebenezer wheeler doth engage as of the other estate so of them faithfully to deliver them to whom they shal belong : & we do all promise and Engage firmly by these presents to stand by & bee well satisfied with what Devision or distribution we have now made without making any further claim excepting what is specified in the promises in witness whereof and for the further confirmation of this our mutiall agreement we have set to our hands & seal this twenty first day of october in the year of our lord one thousand seven hundred and thirteen and in the twelfth year of the Reign of our Sovereign Lady Ann Queen of Great Brittain &c
