Driver's Licence Cancelled.
John Marshaill Logan, aged 54 years, commercial traveller, George street, East Melbourne, was charged at the Carlton Court on Tuesday with having driven a motor-car whilst under the influence of drink.
Constable J. Buffham said - Shortly after 6 o'clock on the night of August 4 I found Logan in a motor car near the railway crossing at Lygon street North Carlton. I saw that a panel of the fence near the railway gates had been broken. I questioned him, but he did not seem to understand what he was talking about.
Thomas James Petridge, signalman, said-I saw the motor car run through the fence adjoining the railway gate. At that time the gates were open for road traffic. Logan was unable to keep his head up.
Dr A H Maxwell, giving evidence for the defence,said-Logan does not possess a strong constitution, and cannot take as much drink as a normal man.
Logan said-A few months ago I was picked up at North Melbourne and taken into a surgery and opterated on. Last Friday, I suddenly became weak and ill, and had a couple of drinks.
Mr Conlon, PM -There are some mitigating circiumstances in this case, but a nun who takes liquor must bear the consequences.
Logan was fined £15 with 18/ costs in default distress, and his licence was cancelled.
