Will Transcript

Will of John Henderson, written August 7, 1824. Will proved June 23, 1826.
In the House of God amen.
I John Henderson of Greene County and State of Tennessee being in perfect mind and memory thanks to almighty God for the same and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament. My soul I trust to the mercy of God in Christ Jesus our Lord and my body I recommend to burial in the earth. I constitute make and ordain my son John Henderson and my son in law M. Payne executors of this my last will and testament.
Item: I give and bequeath unto my daughter Elizabeth Chapman my negro girl Lucy to be for her use and support during her natural life and at her death the Sd. Lucy and increase (if any there be) to descend to her son John Chapman.
Item: I give and bequeath unto my son Samuel Henderson one hundred and forty-five acres of land lying in Greene County joining a small tract belonging to George Masoner and formerly belonging to Jno. Wilson, also my negro man Sam.
Item: I give and bequeath unto my daughter Jean Kilgore the wife of William Kilgore five hundred dollars to be paid to her by my Executors out of my estate for her support in such installments as they shall see that her necessity requires paying due respect to her circumstances that she may not suffer and let it be remembered that this sum above stated is not intended to be levied on in consequence of any of Wm. Kilorges debts nor taken or offered in other way not to any other use whatsoever than the support of her, the said Jean Kilgore as above stated.
Item: I give and bequeath unto my daughter Lydia Kilgore the wife of Jno. Kilgore five hundred dollars to be paid by my Executors out of my estate for her support in such installments as they shall judge her necessity requires and that they pay due respect to her that she may not suffer and let it be remembered that the above is not intended for no other purpose whatsoever and should any part of sd. sum be remaining at her death it is my will that it be given to the support of her son Thomas Kilgore.
Item: I give and bequeath unto my daughter Sarah Hall, the wife of Wm. Hall my negro woman Nancy and her youngest child named Billy (or William) and the said negress remain with her the sd. Sarah Hall during her life for her comfort and support.
Item: I give and bequeath unto my daughter Mary Rhinehart the wife of Jacob Rhinehart sixty seven acres of land known by the name of ??? Place with an entry adjoining to remain and be for her use and support during her natural life and not applied to no other purpose whatsoever and at her death to descend to her son John Rhinehart. Also three hundred dollars paid by my Executors out of my estate to her in such installments as her necessity may require and that due attention be paid to her and not let her suffer and let it be remembered that the afore mentioned sum of three hundred dollars is not to be taken out of the hands of my Executors by no purpose in law or otherwise only as above directed.
Item: I give and bequeath unto my daughter Dorcas Payne, the wife of M. Payne, my negro boy named Tom and my boy named Nud(?).
Item: I give and bequeath unto my son John Henderson eight hundred acres of land be the same more or less being the same that I purchased from the heirs of Benj. Armstrong and George Goodin which I once divided between John and William Henderson including the island adjoining but with this reserve that William Grant have the use of and possession of the same lands that he has formerly had for to make there enough on after my death. Also I give and bequeath unto him my son John, my two negro boys Jerry and George.
Item I give and bequeath unto my daughter Charlotte Hennegar the wife of Henry Hennegar the plantation where on she now lives conveyed by a deed made to me by Anderson Walker (Wacker?) for one hundred acres (let that be more or less) also a deed from sd Anderson and Sam'l Walker (Wacker?) for thirty acres and let it be understood that I mean all the land in these two transactions.
Item I give and bequeath unto my daughter Bethsheba Cragmile the wife of Joseph L. Cragmile my negro girl named Fanny to continue during her natural life for her use and support and not removed for any other purpose whatsoever and at the death of my said daughter Bethsheba the sd negro Fanny and her increase shall descend to the two sons of Joseph Cragmile (viz.) Wm and Pleasant Cragmile
Item I give and bequeath unto my daughter Abigail Grant the wife of Wm. Grant all the lands deeded to me by George Goodin joining (Busler?) Nelson and the lines of a tract above mentioned that I have previous conveyed to my son John Henderson also an entry joining the land conveyed by Goodin containing twelve acres Sd. entry made in my name.
Also I give and bequeath unto my said daughter Abigail Grant my negro boy named Manners which boy at her death shall descend to her son John N. Grant and it is my will and I do order that all my estate whatsoever that is not above bequeathed be sold and equally divided amongst the above mentioned legatees: Remembering that the part of such sale coming to Jean Kilgore, Lydia Kilgore and Mary Rhinehart remain and be in the hands of my Executors and faithfully apply as above directed and I do require and charge you my executors (viz.) John Henderson and M. Payne that you use your best endeavors to render to those my three daughters that is Jean and Lydia Kilgore and Mary Rinehart their due in such time and manner as may be most for their happiness and comfort and further I do will and order that Wm. Kilgore's son James Kilgore be sent to an English school and learned to read, write, and cipher through the rule of three and that the expense be paid out of my estate and I do hereby disannul all other wills or testaments by me whatsoever: Ratifying this to be my last will and testament in witness whereof I have unto set my hand and seal this 7th day of August 1824.
N.B.(?) My negro woman Dicy I do not allow to be sold but let her make choice which of the before mentioned legatees she will go to and there let her abide and I request that she be used in such a manner as her circumstance require.

Kilgore and Lydia his wife, Merryman Payne and Dorcas his wife, Jacob Rinehart and Mary his wife, and John Henderson heirs at law of John Henderson dec'd and John Henderson and Merryman Payne the personal Representatives of the said John Henderson dec'd and with leave of the court say that they claim no Interest in the subject matter in Dispute in this cause, and they hereby disclaim all Right, Title or claim to the same, and they prey to be hence dismissed with their reasonable costs in this behalf expended. Court adjourned until Tomorrow morning at 9 O;Clock.
