Marriage Bond

Will Transcript

I, John Hawpe of the County of Augusta and State of Virginia (Farmer) do make and publish this my last will and testament hereby revoking void all former wills by me at any time heretofore made and first I direct that my body be decently interred in the burying ground on the plantation where I now reside according to the rights and ceremonies of Presbyterian Church, and that my funeral be conducted in a manner corresponding with my situation in life and as to such worldly estate as it hath pleased God to intrust me with I dispose of the same as follows.
First, I direct that all my debts and funeral expenses be paid as soon after my decease as payable out of the first money that shall come into the hands of my executors from any portion of my estate.
Second, I give and bequeath to my son John Hawpe the plantation on which he now lives on according to the meets and bounds which were shown to said John and William S. Hawpe by me some years since with the privilege of the road as it now runs from the pine run to the main road leading from Staunton to Greenville by the sawmill the said John Hawpe is to keep the road that passes through his land in good repair. I also give to my son John Hawpe the tract of pine land that I purchased from Robert Steele known as the deep pond tract together with other small tracts; my intention in making this bequest is to give the said John Hawpe all the pine land except the tract I bought of Turk and one other tract I bought of McCarty. I also give said John my negro man Sam.
Third, To my son Adam M. Hawpe I give the plantation on which he now lives and also the tract of land I purchased of John Rigel with the privelege of a road as it now runs from his house to the main road by the sawmill also my negro man Rufus.
Fourth, To my sons John and Adam I give a mutual equal interest in the tract of pine land I bought of James Turk.
Fifth, To my son William S. Hawpe I give the plantation I now live on with the privilege of using the roads herein mentioned. I also give the said William the tract of pine land that I bought of McCarty adjoining the lands of Thomas Williams and others. I also give my said son my negro man Leenburough also my two negro women Sarah and Nancy also all my household and kitchen furniture, all my horses and one half of my cattle, one wagon and gear and all the farming utensils and tools now in the possession of the said William S. Hawpe.
Sixth, It is my will and desire and I hereby give to my three sons John, Adam M., and William S. Hawpe an equal interest in the sawmill with its appurtenances in making the bequest to my son William of the land I now live on mentioned in the 5th clause it was not in my intention to give him the exclusive right to the sawmill in making this bequest. It is not my intention to give my (John Hawpe) Two sons John and Adam a right in few simple to said sawmill and its appurtenances I only intended them to have the use and benefits of it without any right to convey their interest to any other person.
Seventh, I give to my three sons John, Adam, and William S. Hawpe jointly the tract of land I bought of Henry Shultz estate which tract of land was sold under a decree of the Circuit Superior Court of Law and Chancery for Augusta County.
8th, To my daughter Catherine Shultz I give $1,200 dollars but this bequest is subject to the following deductions; she is to be charged with the amount of property she bought at the sale of her deceased husband (Henry shultz) which amount will appear by reference to a receipt in the hands of Adam M. Hawpe, no interests is to be counted on said claim also the further sum of $100 which I paid to Joseph Dettor also without interest.
9th, To my daughter Betsey Shields I give $1,200 dollars subject to advances made by me to her for which I hold receipts which amount is to be deducted without interest.
10th, To my son in law Elijah Carson (who intermarried with my daughter Polly Hawpe) I give $1,200 subject to deduction for notes I hold on said Carson with their interest.
11th, To my three sons John, Adam M., and William S. Hawpe, I give all the residue of my estate after the payments of my debts and legacies herein before bequeathed to be equally divided between them. I do hereby make and ordain my thee sons executors of this my last will and testament and lastly my express will and desire is and I do hereby order and appoint that if any differences or dispute, question or controversey shall arise or happen concerning any Gift bequest or other matter on this in this my last will, give and bequest exposed or contained that then no suit or suits in law or equity or other wise shall be brought or presented for and concerning the same but the same shall be referred wholly to the award order and determination of three arbitrators to be chosen by my three sons each to appoint one and what the arbitrators as a majority of them shall order direct or determine therein shall be binding and conclusive to and on all and every son or persons therein concerned.
In witness whereof I, John Hawpe have to this my last will and testament contained in this and the preceding page set my hand and seal to set my hand to the bottom of the first and second set my hand and seal to the third page the writing contained in this and preceding page was signed and sealed by the before named John Hawpe and by him published and declared as and for his last will and testament in the presence of us who have hereunto subscribed our names in his presence and in the presence of each other this tenth day of September one thousand eight hundred and forty four.

Whereas, I John Hawpe of the County of Augusta have made and duly executed my last will and testament in writing bearing the 10th day of September 1844 now I do hereby declare this writing to be a codicil to my said last will and testament and direct the same being drawn a part of the same sheet of paper to be taken apart of and I do hereby give and bequeath to my son William S. Hawpe the right to a road through the lands heretofore willed by me to my son John Hawpe commencing at the bend in the land near the top of the hill in the land leading from my house to said John Hawpe’s through the field near the top of the ridge to a pine near the corner of Hugh Brownlee’s field corner to Vines and Brownlee the road to be sufficient breadth for a wagon road the said road is not to be kept open but said William S. Hawpe is to make and keep up sufficient gates on said road in witness whereof I the said John Hawpe have to this codicil set my hand and seal this 9th day of June 1849.
Signed, sealed and published by the said John Hawpe as a codicil to be added to be considered as part of his will and testament in the presents of us we have subscribed our names in his presence.

Augusta County Court October Term 1849
This last will and testament of John Hawpe dec’d with a codicil thereto annexed was presented in court and said will proved by the oaths of John Newton and Hugh Brownlee the subscribing witnesses threto and said codicil proved by the oaths of said John Newton also a witness thereto and said codicil is concern for further proof.

Augusta County Court November Term 1849
This last will and testament of John Hawpe dec’d with the codicil annexed was again presented in Court and said will being proved in court at last term and said codicil partly proved the said codicil was this day further proved in Court by the oath of John H. Carson a subscribing witness thereto and said will and codicil ordered to be recorded and thereupon the executors named in said will appeared in court and refused to take upon themselves the burden of its execution and on the motion of John Newton and Benjamin F. Graham who made oath according to law and with Adam M. Hawpe and John Hawpe their securities entered into and acknowledged a bond in the sum of $20,000 conditioned as the law requires which bond is ordered to be recorded. Certificate is granted the said John Newton and Benjamin F. Graham for obtaining letters of administration with the will annexed of John Hawpe Senr deceased in due form.

    DIED, on Thursday last, at his residence near Greenville, JOHN HAWPE, Sr., in the 90th year of his age. -- The deceased was a plain, unassuming and unpretending man, highly respected, and a sincere friend.
