    Will of "John Emery of Newbury ... yeoman", dated 6 April 1756, names son Joshua Emery; son Anthony Emery; daughter Hannah Holman; daughter Sarah Chase; daughter Judeth Smith; daughter Hitte Morss, daughter Mary Smith; son David Emery. Son David to be executor.
    4 Sep 1759: Petition of David Chase that my father in Law mr John Emery Late of Newbury is desest and his son David Emery is about to present his will, my Selfe and others Interested in the s'd Johns Estate [later mentions John's sons Joshua and Anthony] are well satisfied that he was not of a sound and disposing mind, and requests a hearing before proving. Will was proved at the hearing 13 Nov 1759.

  5. The birth dates of John and Jonathan have been muddled by Source:Emery, Rufus. Genealogical Records of Descendants of John and Anthony Emery, of Newbury, Massachusetts, 1590-1890, which lists John b. 1678 and Jonathan b. 2 Feb 1680. The records of Newbury are very hard to read, but it clearly appears that the record in 1678 Vol. 1, p. 157 is for Jonathan (and by the context formed by the surrounding records, this is 1678/79) as is reported in the published VRs. No record for John has been located.

    The birth of Mary is found on p. 152, 25 Sep 1667 as published in the VRs. Between this record and Jonathan's birth, it appears to conclusively rule out a birth of John in 1678, and given the parent's marriage in 1676, suggests John was born later than 1678 (i.e., his age at death was inflated, which was common).

    In the probate file of John's father, John declines administration on his father's estate in favor of his brother Anthony, even though, as he points out, he is elder than Anthony. This means he is born before 1684, and given the birth of David in 1682 (p. 175), John's birth would appear to be in the gap about 1680.
