Acquisition of Land from Virginia Northern Neck Land Grants:

Will Transcript

In the name of God amen, I John Capper of the County of Frederick in the Commonwealth of Virginia being sick and weak in body but of sound mind and disposing memory for which I thank god, and calling to mind the uncerty [uncertainty] of human life, and being desirous to dispose of all such Worldly Estate as it hath pleased dog to bless me with ~ I give and bequeath the same in manner following that is to say, my wish is that all the money that I may be possessed of at my decease, shall be put in the hands of my Executors, and also all notes bonds and book amounts that I may have against any person or persons remaining unpaid for my Executors to collect the same and out of the money put into their hands and to be collected by them as aforesaid to pay all my Just debts and funeral Expenses
my will and desire is that Alie Brunner my Granddaughter shall have all my personal Estate that which is hereafter Excepted.
I give to my two grandsons Michael and David Capper my stills and all the utinsils thereunto belonging for the purpose of assisting their mother in the raising their younger brothers and sisters, my will is that Michael Capper my grandson shall pay Alie Brunner, and Sarah Barnhazle ten pounds each to be paid in four equal annual payments to Each of them after he shall arrive at the age of Twenty one years, towards the support of themselves and their children, my will is that my grandson David Capper shall pay to Sarah Capper his mother, and to Mary Kaile his sister ten pounds each after he shall arrive at the age of Twenty one years to be paid to Each of them in four equal annual payments Each ~
My will is that Charles Capper my Grandson, shall pay to Delila Capper and Ann Capper his Two Sisters two pounds Each, to be paid in four equal annual payments to each of them after he shall arrive at the age of Twenty one years.
My will is that Gabriel Capper shall pay to Prisilla Capper and Lydia Capper his Two sisters ten pounds each to be paid to each of them in four equal payments to each after he shall arrive at the age of twenty one years.
My will is that Merydith Capper shall pay to Eleanor Capper and Synd Capper Two of his sisters ten pounds each to be paid to each of them in four equal annual payments to each of them after he shall arrive at the age of Twenty one years.
My will is that Merydith Capper shall have all my land lying on the little Trenberidge adjoining the land of Bogans Heirs containing 203 acres by survey be the same more or less to him and his heirs forever.
I give and bequeath unto my four Grandsons that is to say Michael, David, Charles and Gabriel Capper all the residue of my lands either in Frederick and Hampshire Counties to them and their heirs forever to be dived [divided] in manner following, when it can be assertained ___ I have a good title to my will is that a sight? line be ran parallel with a blazed line, which may be sum? in the No. West, drain of Harple Hollow run so as to make an equal quantity of land on each side of said line and that part that will fall on the So. East side of said line to be equally divided between Michael and David Capper agreeable to quality and quantity, and then for them to Cart lots for the choice of plantations and the land that shall fall on the No. West side of said blazed line to be equally divided agreeable to quality and quantity between Charles and Gabriel Capper, and then for them to cast lost, for the choice of plantations
My will is that neither David Capper shall Cut any Timber off the land I give Charles and Gabriel Capper nor shall Charles nor Gabriel Capper Cut any timber off the land I give to Michael & David Capper without the consent of each other after they shall arrive at the age of Twenty one years.
My will is that if my Grandsons beforementioned shall incline to sell the land I have bequeathed to them, that they hall first have the land valued by some disinterested persons, and if their other brothers shall incline to purchase they shall let them have it at such valueation as aforesaid, upon condition that they do give them bonds with good security for the valuation money which shall be paid in four equal annual payments to Each.
My will is that if any of my Grandsons shall die before they shall leave an heir legally begotten by them that the land I have bequeathed them shall be equally divided between their other Brothers, which may survive.
My will is that if the dividend of land I have given to my four Grandsons Michael, David, Charles and Gabriel Capper shall exceed two hundred and fifty acres each that they shall pay to their brother Meredith Capper, five pounds each one year after they have paid the legacies I have left to their mother and sisters.
My will is that if there shall be any of my money in the hands of my Executors after all demands shall be paid that shall come against my Estate, and every thing settled with my Grandchildren aforementioned that my Executors shall divide the same among my Grandchildren equally which may be then living, which I give to them and their assigns forever.
And lastly I do hereby constitute and appoint my friend John Faucet, Thomas Faucet, Samuel Gandy and James Caudy Executors of this my last will and Testament, and I do hereby disallow and disannul all Testaments wills legacies, bequeaths and Executors by me in any wise heretofore made.
In witness whereof I have hereunto set my hand and seal this 5t. Day of March 1806.

At a Superior Court Continued and held for the District Composed of the Counties Frederick Berkeley Shenandoah and Jefferson at Winchester the 20th day of April 1808.
This last will and Testament of John Capper deceased was produced to the Court and proved by the oaths of William Geffin and Jonathan Smith witnesses thereto and ordered to be recorded. And at a Superior Court Continued and held for the District aforesaid the 22d day of April 1808, Thomas Faucet, John Faucet, Samuel Caudy and James Caudy named as Executors in the within will by their writings under their hands and seals proved to the satisfaction of the court refused to take upon themselves the burthen of the Execution of the said will.
And at a Superior Court continued and held for the District aforesaid the 23d day of April 1808. On the motion of Jesse Pugh who made oath and entered into bond together with Jacob Rinker his Security in the penalty of one Thousand Dollars Conditioned as the law requires, a certificate for obtaining letters of administration of the Estate of John Capper deceased in due form is granted him, with the will of the said John Capper annexed.
