Early Land Acquisition in Augusta County, VA

Acquisition of Land from Chalkley's:

  • Page 400.--19th January, 1790. William Christian, Jr., to Jacob van Lear, 40 acres devised to William by William Christian, deceased, part of tract Andrew Wilson now lives on, on Christian's Creek.

Will Transcript

I Jacob Vanlear of the County of Augusta and State of Virginia do hereby make my Last will and Testament in the Manner and form following that is to say,
First I desire all my Just debts to be paid out of the moneys arising from the debts due me, If that should not prove sufficient my wife Jane Vanlear shall discharge the same from the funds I have hereinafter devised to her.
Secondly, After the payment of Just debts and funeral expenses, I give and bequeath to my beloved wife Jane Vanlear all my personal property except such as is hereinafter particularly specified and bequeathed.
I give to my sd. wife one negroe woman called Jane to be disposed of by her at her death or in case she should marry, to any one of her two daughters, Viz. Rebecca or Eveline which she may think proper. I also give to my wife Jane during her natural life or widowhood, all that part of my plantation which I now live on except the two fields lying west of my house adjoining the Lands of James Moffett, which may be fully ascertained by a reference to different conveyances to me and my conveyance to my son Jacob Vanlear.
It is my desire if my wife Jane should Marry she is only to receive that part of my Estate which she may be entitled to by the Laws of Virginia.
Thirdly, I Give and bequeath to my son Jacob Vanlear his heirs and assigns forever (after the death of my wife Jane or her intermarrying) all my Lands which I have bequeathed to my wife Jane during her natural live or widowhood. I also give to my son Jacob Vanlear two negroe men. Viz, Ned and James, at my death also one Alock? the above bequeaths are in consideration of my son Jacob paying such sums of money to my Daughters as I shall particularly hereafter direct to be paid by him. I further give to my son Jacob two fields laying west from my home and along the creek adjoining the lands of James Moffett and his own Lands at my death that is as to the last bequeathed to my son Jacob it is in consideration of furnishing my wife Jane in firewod? and a loy? to do here anarents? to while she continues to keep house on the farms she now live on but should she remove from sd. farm or intermarry my son Jacob is to be released from the last consideration.
I further desire that my son Jacob let the Clock remain in the house as long as my [wife] continues to keep house on the farm.
Fourthly I give to my Daughter Ann McKee one hundred Dollars in addition to what I have already gave her, to her paid by son Jacob at my Death.
Fifthly, I give to my Daughter Arabella Caldwell one hundred Dollars in addition to what she has rec'd. paid by my son Jacob at my death.
Sixthly, I give to my Daughter Sally Davis One Hundred and fifty Dollars in addition to what she haz rec'd to be paid by my son Jacob one year after my death.
Sevently, I give to my daughter Rebecca Davis one hundred and fifty dollars in addition to what she haz rec'd from me and son Jacob to be paid by my son Jacob one year after my death.
Eightly, I give to my Daughter Evelina H. Wayland four hundred Dollars exclusive of what has been ordained by myself and my son Jacob, the paid Four hundred Dollars to be paid by my son Jacob.
Lastely I do hereby constitute and appoint my wife Jane Vanlear & my son Jacob Vanlear my sole executors to this my last Will and Testament hereby revoking all other former wills or testaments by me hereto fore made.
In witness thereof I have hereunto set my hand and affixed my seal this eight day of October 1821.

Augusta County June Court 1822
This last Will and Testament of Jacob Vanlear Senr. dec'd was presented in Court and proved by the laths of William Abney and Robeert L. Moffett two of the Witnesses thereto & ordered to be recorded. And on the motion of Jacob Vanlear one of the Executors therein named who made oath thereto and together William Gildersons and James Christian his securities entered into and ack'd their bond in the penalty of $3,000 Conditioned as the Law requires which bond is ordered to be recorded. Certificate is granted him for obtaining probat of said Will in due form, and leave is reserved for the other executor therein named to qualify when she shall think fit.

Executors, sons William and James. Teste: John Gamble, Jos. Snapp, Jacob van Lear. Proved, 27th May, 1811. Executors qualify.
