About Jacob Lockhart, Jr.

Jacob Lockhart, Jr., the son of Jacob Lockhart of Augusta County, Virginia. According to some sources, he may have been married twice; first to an Elizabeth [acording to some unsourced listings], and second to "Mary", who he named in his will written in Greenbrier County, Virginia on March 31, 1784. Jacob is listed as participating in "Lord Dunmore's War" in 1774. [Source: "Virginia Colonial Militia", Crozier]. Jacob is said to have been killed by Indians, probably in Kentucky [sources needed], and listed his three sons, Charles, James and John, and daughters Agnes and Elizabeth in his will. He may have also had a younger daughter "Mary", who is listed in Court records in Harrison County, Kentucky as "not yet of age", unless this is the same daughter listed as Elizabeth [perhaps Mary Elizabeth?] in his will. In the neame of god ameain
I Jacob Lockhart of Greenbrier Countey and Steate of Virginia being of perfect mind and memorey at this time But Coaling to mind the mortallitey of my Boddey Knowing that it is apointed for all men to die I meake and ordeain this to be my Last will and Testement and I dow Renounce and Decleair all former Wills to be void first of all I Recommend my Soule To god and touching Such wourley goods as it heath Pleased god to blis me with I bequith in the following manner and form I bequth to my beloved wife meorey [sic, Mary] one bay meare of the Dismil Stream besides hir full thirds which she is intiteld to by Law Likewise I bequith to my three sons Charls James and John all my Land in Ceaintuckey to be equeley Divided betwixt them according to Quantitey and Qualletey Likewise I bequith to my two Daughters Agness and Elizebeth fiftey pounds Each Current money of Virginia and the Remeainder of my Esteate after my Just Debts are payed to be Equley Divided betwixt my three Sons and for the Discharing of my Debts I alow all my Land in green brier Countey to be Sold as well all my Entreye that is not Survayed as them That is Surveyed and I Dow herby apoint my beloved Frends Coln Andrew Donneley Capt George Clindinian and William Ward to be my Execeters I dow Declair This to be my Last will in witness Whereof I heave herunt Set my hand and Seale this 31st of March 1784

At a Court held for Greenbrier County the 23rd day of March 1786. This Instrument of writing as & for the last Will and Testament of Jacob Lockhart Decd was presented in Court & prven by the Oath of Alexr Welch a Witness thereto & ordered to Record on the Motion of Andw Donnally & Geo Clendinen, Excrs namd therein, who made oath according to Law, Certificate granted them to obtain a probate thereof, whereupon they entered into and acknowledged with their bond with Conditions as the Law directs, Copy, Teste

Land Records

Jacob Lockhart received a Military Land Warrant of 1,200 Acres, from Patrick Henry, the governor of Virginia in 1785.
Military Warrant for the 1,200 Acres on Mill Creek, is submitted to the court, "there is a grant by the said Commonwealth, unto Jacob Lockhart....a certain track or parcel of land containing twelve hundred acres by survey, bearimg dates the 13th day of January, 1783, lying and being in the County of Fayette on Mill Creek". This Warrant was signed the 14th day of February, 1785

1774–“Lord Dunmore’s War – Captain Stewart’s Company: Jacob Lockhart, on Comd.” [Crozier, "Virginia Colonial Militia," p.86]
1776 Jul 17, Wed.–Meeting–Ordered, that a warrant issue to Lt. Andrew Wallace for the use of Joseph Lapsley for £3.9 for sundries furnished Capt. Posey’s Company and for use of Jacob Lockhart, £4 for riding express on public service. [Journal of the Council of the State of Virginia, pp.72-73]
1783 May 27–Jacob Lockhart, Jr., of Greenbrier County, Virginia (now WV) granted power of attorney ‘to my trusty friend, William Jamison’ to convey title of land he held in Augusta County, Virginia, which adjoined lands of Peter Hanger and Robert Clark.


Records in Kentucky

Harrison County, KY Land Deed Books:
"Know all men by those present that I, Charles Lockhart of the County of Harrison and Commonwealth of Kentucky, am held and bonded into Andrew Robinson, James Lockhart, John Lockhart and Mary Lockhart of the same County and Commonwealth in the just and full sum of twenty thousand Pounds. current money....sealed with my seal this 3rd day of December, 1798." It goes on to say, "The condition of the above obligation is such that, where as Jacob Lockhart, Dec., made a will before his death, which will is disputed by the said Charles Lockhart....in case said land or any part there of should be lost by any prior claims." It goes on to say, "When the said Mary Lockhart is of age and where as the said Mary Lockhart shall arrive at the age of Twenty One, make her a deed in the same manner for one fifth of the said land." Signed by Charles Lockhart.
On the same page is the following "We do hearby sign over all of our rights, titles, interest, claims or demands, of the within bond, or any claims I may have in the will made by Jacob Lockhart, Dec., as Heir at Large, by marriage to his daughter Nancy, to Jacob Smiger and William Coleman (Attnys)....given under our hand, this 13th day of August 1805.

[Note: It is thought that this record shows that Nancy (Lockhart) Robinson, and Charles, James, and John Lockhart, must be children from a previous marriage that Jacob had].
