From the journal of his daughter, Catherine:

He was called into the work of the ministry in about the eighteenth year of his age; and when young, travelled much in the service of Truth in divers parts of this nation, Ireland and Scotland, as also the American colonies. His ministry was lively and clear; and his care not to exceed the openings of Truth therein, apparent. His deportment was grave, his conduct clean and steady, and his charity, in proportion to his circumstances, diffusive. He was an affectionate husband, a tender father and kind master; serviceable amongst his neighbours, and beloved and respected by them. He died in the year 1746, aged nearly 75 years.

    Be it known that I Henry Payton of Dudley in the County of Worcester Malster being thoughtfull of my Mortality am willing to settle my worldly Affairs and do make this my last will and Testament in manner following that is to say I give and devise Ratify and confirm unto my Son Henry Payton all the Lands Tenements and Hereditaments which were in any manner settled in Joynture upon Mary my first wife deceased Mother of him the said Henry And I also give and bequeath unto my said Son Henry Payton a Silver Tankard and a Trunk that belonged to my said late wife Mary his Mother I also give devise and bequeath from and after all my just debts Legacies and funeral Expences be well and truly paid and discharged all and singular my Goods and Chattels and all Mortgages Bonds Leases Specialitys Notes and other Securities for money and all other my Personal Estate of what nature or Kind soever to John Fowler of Woolverhampton in the County of Stafford Mercer John Brettell of Halesowen in the County of Sallop Maltster and John Bradley of Stowerbridge in the County of Worcester Mercer and the Survivors and Survivor of them and the Executors Administrators and Assign of such Survivor upon this Special Trust and confident that they the said John Fowler John Brettell and John Bradley and the Survivors and Survivor of them and the Executors Administrators and Assigns of such Survivors do permit and Suffer my loving wife Ann to occupy possess and Enjoy the same and receive the Issues and profits thereof during her natural life and from and after her decease then my mind and will is that they the said John Fowler John Brettell and John Bradley and the Survivors and Survivor of them and the Executors Administrators and Assigns of such Survivor do permit and Suffer my Children Stephen Hannah James Ann and Catherine and all and every or any or such of them to have take and receive all such Goods Chattells Sum and Sums of money Mortgages Securtys Bonds and all other my said Personal Estate or any and every part thereof at such times and in such manner and proporsons as my said Wife Ann shall by her last Will and Testament in writing Duly Executed or by any other Instrument in writing under her hand and Seal Limit declare direct and appoint and if it shall happen that my said Wife Ann shall be minded and desireous to dispose or give all or any part of my said personal Estate in the Life time of her the said Ann unto any of my said Children Stephen Hannah James Ann and Catherine then my will and mind is that they the said John Fowler John Brettell and John Bradley and the Survivors and Survivor of them and the Executors and Administrators of such Survivor do permit and Suffer all and every or such of my said Children to take receive hold and enjoy the same accordingly and if it shall happen that my said wife Ann shall happen to die without disposing of all or any part of my said personal Estate in manner as aforesaid then my mind and will is that the said John Fowler John Brettell and John Bradley and the Survivors and Survivor of them and the Executors Administrators and Assigns of such Survivor shall make a division and distribution of my said personal Estate or such part thereof as shall remain undiposed of as aforesaid unto and amongst my said Children Stephen Hannah James Ann and Catherine in manner following that is to say Whereas I have already given unto my said Son Stephen the sum of three hundred pounds and have settled and Estate in Land upon my said Son James after the death of me and my said Wife Ann which I compute to be worth three hundred pounds therefore my will and desire is that the said John Fowler John Brettell and John Bradley and the Survivors and Survivor of them and the Executors Administrators and Assigns of such Survivor do make such division and distribution of my said personal Estate (that with what Estate I have already given in my life time and what Estate may be given and disposed of by my said Wife in her life time) unto my said Children Stephen Hannah James Ann and Catherine so that every one of them may have as much as the other and be made Equivalent to what money or Estate shall have been given or disposed of to such or any of my said children as above mentioned I also give devise and bequeath unto the said John Fowler John Brettell and John Bradley all and every my Messuages Dwelling Houses Cottages Buildings Lands Tenements and Premisses whatsoever and wheresoever in the Parish of Dudley in the County of Worcester and in the Parish of Tipton alias Tibbington in the County of Stafford and all other my freehold Messuages Dwelling Houses Lands Tenements and Premisses whatsoever and where ever the same are situate lying and being to hold the same unto the said John Fowler John Brettell and John Bradley their Heirs and Assigns for ever to the several and respective uses Intents and Purposes herein after particularly mentioned that is to say to the use and behoof of my said Wife Ann and her Assigns for and during the Term of her natural Life and from and after her decease to the use and behoof of such or all or any of my said Children Stephen Hannah James Ann and Catherine in such parts and proportions and in such manner as my said wife Ann shall by her last Will and Testament in writing only Executed or any other Testament(?) in Writing under her hand and Seal limit direct and appoint to them and their Heirs and Assigns for ever but if it shall happen that my said Personal Estate shall not be Sufficient to pay of all my just debts or if it shall happen that my said Wife shall be minded or desireous to raise and pay any Sum or Sums of money to all or any of my said Children Stephen Hannah James Ann and Catherine for their Marriage portions or for any other occasion whatsoever for them or any of them that then and in such case my Will and desire is (that at the request and by and with the full consent and approbation of my said Wife Ann to be Testifyed by any writing under her hand and Seal in the presence of two or more credible witnesses) that they the said John Fowler John Brettell and John Bradley shall be Sale or Mortgage of all my said Messuages Dwelling Houses Cottages Lands Tenements and premises or any part thereof reasie and pay all such sums of money in manner as aforesaid And that if it shall happen that my said Wife Ann shall depart this life without such declaration or Limitation as aforesaid that then and in such case I give devise and bequeath all my said Messuages Dwelling Houses Cottages Lands Tenements and premises or such part thereof as shall remain unsold at the time of my said wife Ann's decease unto the said John Fowler John Brettell and John Bradley their heirs and Assigns upon this special Trust and confidence that they the said John Fowler John Brettell and John Bradley their Heirs and Assings shall make an Equall and proportionable partition of all such my Messuages Dwelling Houses Cottages Lands Tenements and Premisses and convey the same to my said Children Stephen Hannah James Ann and Catharine or such of them as shall be then living and to their Heirs and Assigns for ever nevertheless having respect to what Estates and Sums of money shall be given and disposed of to them in my life time and in the life time of my said wife Ann and to make such of their partitions equal and proportionable in value to the Estate and money that shall have been given and disposed of as aforesaid to the other of my said Children so that the whole of their portions may be equally share and share alike I also give devise and bequeath unto my Daughter Mary for and during the term of her natural life an Annuity or Rent Charge of twelve pounds a year to be Issuing and payable out of all or any of my said Messuages Dwelling Houses Cottages Lands Tenements and Premises for her Maintenance to be paid unto her or her Assigns at four equall payments in the year that is to say on the twenty fifth day of March the twenty fourth day of June the twenty ninth day of September and the twenty fifth day of December the first payment to begin and be made upon the first of the said Days that shall next happen after my decease and if default shall be made in payment upon any of the said days aforesaid then I direct Impower and appoint my said Daughter Mary and her Assigns to Enter into upon the said premisses or any part thereof and the Rents Issues and profits thereof or any part thereof to detain and keep until all the said Rent and Arrearages together there with all charges shall be fully Paid and Satisfied And I do constitute nominate and appoint my said Wife Ann sole Executrix of this my last Will and Testament And also Guardian of all my said Children until they severally attain their respective Ages of twenty one years And I do hereby Revoke disannul and make void all former and other wills by me heretofore made In witness whereof I the said Henry Payton have to this my last Will and Testament and Duplicate hereof contained on two sheets of paper set my hand and Seal this ninth day of September in the Eighth year of the Reign of our Sovereign Lord George the Second by the Grace of God of Great Britain France and Ireland King Defender of the faith and so forth and in the year of our Lord one thousand seven hundred and thirty four Henry Payton     I Henry Payton of Dudley in the County of Worcester Malster do make and publish this Codicil to my last Will and Testament in manner following whereas I have by my last Will and Testament whereunto this Codicil is annexed given and devised and bequeathed unto John Fowler John Brettle and John Bradley all and every my Messuages Dwelling Houses Cottages Buildings Lands Tenements and Premisses whatsoever and wheresoever in the Parish of Dudley in the County of Worcester and in the parish of Sedgeley in the County of Stafford and in the parish of Tipton Alias Tibbington in the said County of Stafford and all other my Messuages Dwelling Houses Land Tenements and premises whatsoever and wheresoever the same are Situate lying and being to several uses as therein are mentioned And whereas all my Messuages Dwelling Houses or Tenements Land and Premisses Situate lying and being in the parish of Sedgeley are Deemed and taken to be Copyhold Lands holden of the Lord of the Manor there now I do hereby declare and it is my Interest and meaning that no Estate or Interest in any Copyhold Lands and premisses to which I am in any way Intitled shall be vested or settled in any person or persons whatsoever by Virtue of any Gift devise or bequest by me made In witness whereof I have hereunto set my hand and Seal this third day of February in the year of our Lord 1736 Henry Payton Signed Sealed and Published by the said Henry Payton as a Codicil to be annexed to his Will in the presence of us William Wharton Junior Sarah Wharton Edward Price Senior

    This Will was proved at London with two Codicils annexed before the Right Worshipfull John Bettesworth Doctor of Laws Master Keeper or Comissary of the Prerogative Court of Canterbury lawfully constituted on the twentieth day of December in the year of our Lord one thousand seven hundred and forty six by the Solemn and Sincere declaration of Affirmation of Ann Payton Widow the Executrix named in the said Will to whom Administration was granted of all and Singular the Goods Chattels and Credits of the deceased having first made the declaration or Affirmation aforesaid by Comission only to Administer
