Will Transcript

WILL OF HANNAH (FENIMORE) FENTON, October 26, 1816
I Hannah Fenton of the County of Frederick and Commonwealth of Virginia being of sound and disposing mind and memory calling to mind the uncertainty of life do make this my last will and testament.
I give and devise to my grandson Josiah J. Fenton and his heirs forever all that tract or parcel of land I purchased from Conrad Soy situate in the County of Frederick and the Commonwealth of Virginia on Babbs run and Hunting ridge containing one hundred and thirty seven acres more or less with its appurtenances subject to the payment of three hundred dollars to his brother Benjamin Fenton Jun'r.
Upon the said Benjamin attaining the age of twenty-one years I give and bequeath to the said Benjamin Fenton Jun'r all that piece tract or parcel of land that I am entitled to as one of the representatives of my daughter Rebeckah Fenton deceased containing fifty acres be the same more or less with its appurtenances to his and his heirs forever. I also give and bequeath to the said Benjamin Fenton Jun'r three hundred dollars to be paid by his brother Josiah J. Fenton upon the said Benjamin Fenton attaining the age of twenty one years.
It is my will and desire that my negroes Phillis be free and her children Hence (Henson, Isaac, Joshua and Poll be hired out by my executor until they are of the age of twenty one and that they then be free. It is my will and desire that Bets serve Sally Davis until she is twenty five years of age and that on her arriving at the age of twenty five years she shall be free and that Polls children if any she should have be born free; that Jonathan be hired out until he is entitled to freedom by the last will and testament of my husband Enoch Fenton, and that Tom be hired out until he arrives at the age of twenty five years and that he shall be free, and that Sam be hired out until he is the age of twenty five years and then set free. It is my will and desire that if Bets should ever have any children they shall be free born.
I give and devise to my son Enoch Fenton all my land on the waters of Isaacs Creek that were devised to my by my Husband Enoch Fenton with its appurtenances to him and his heirs and assigns forever.
I do nominate and appoint my son Benjamin Fenton the executor of this my last will and testament and desire that he in hireing out the negroes be careful to hire them to the most humane masters he can conveniently find and that the said Benjamin Fenton be not compelled to give security nor have my estate appraised. The residue of my estate of every description I have and bequeath to my grandsons Josiah J. Fenton and Benjamin Fenton Junr.
I hereby declare it to be my wish and so to be understood that the hire of my negroes heretofore mentioned be kept in the hands of my executor as funds to pay my debts if any should be at my death and the surplus if any to divide equally between my two grandsons Josiah J. and Benjamin Fenton Junr. If there should be no debts then the whole to be equally divided between the said Josiah and Benjamin.
In testimony whereof I have hereunto set my hand and seal this 26th day of October 1816.

CODICIL TO THE WILL OF HANNAH (FENIMORE) FENTON
November 29, 1820
I do by this codicil the 29th day of November 1820 so far alter the within that the said Josiah J. Fenton is to hold the within devised land clear of the encumberance of paying Benjamin three hundred dollars. I do in lieu of the three hundred dollars give and devise to the said Benjamin the land adjoining the piece within devised to him that I purchased from Benjamin Daniels. I do hereby declare this to be taken as part of my last will and testament,.

Proved - February 28, 1825
At the Court held for Frederick County the 28th day of February 1825 this last will and testament of Hannah Fenton deceased was proved by the oaths of Joseph Sexton and David Fries witnesses thereto and the codicil thereto amended was proved by the oath of Joseph Sexton and affirmation of Benjamin Fenton witnesses thereto and said will and codicil ordered to be recorded.
