Will Transcript

I Frederick Painter senior of the County of Amherst and state of Virginia do hereby make this my last will and testament in manner and form following that is to say –
First I desire that my horse saddle and bridle be sold immediately after my decease and that out of the money arising from said sale and debts owing to me that all my just debts be paid and also my funeral expenses
Secondly I desire that my land may be sold on three equal annual payments it being the land I formerly owned which I lately bought of Thomas Jordan
Thirdly, I desire that my wife may not be permitted to receive any part of my estate from reasons best known to myself.
Fourthly – I give to my five children (towit) Frederick Painter, Jr., John Painter, Samuel Painter, Elizabeth Painter & Henry Painter my whole estate to be equally divided amongst them to them and their heirs forever but it will be understood that my Executor hereinafter named shall hold my daughter Elizabeth share in his own hand and pay it to her in the way of furnishing her with such necessary articles as she shall need upon which subject he is to exercise his own discretion.
Fifthly – I desire that my daughter Elizabeth may leave her mother and live with one of her brothers
Lastly I do hereby constitute and appoint my son Henry Painter sole Executor of this my last will and testament revoking all other and former wills by me made and my desire is that the Court may not require security of my Executor as I owe but little.
In witness whereof I have here unto set my hand and affixed my seal this 7th day of September 1826.
