Parentage of Francis Beatty

Francis Beatty is a probable son of Francis Beatty (b. est. 1707, Ireland, d. 1773, Mecklenburg County, North Carolina, who named a son Francis in his will. This Francis Beatty has been confused by some researchers with his probable father (There are several Familysearch submissions claiming that this Francis Beatty was born in abt. 1700, the son of Arthur Beatty and Martha Cairns, but this was his probable father, Francis Beatty). This Francis Beatty apparently did not follow his father to North Carolina and stayed in the Augusta County area, moving to nearby Washington County, Virginia prior to his death in 1791.

Will of Francis Beatty

In the name of God Amen. I Francis Beattie of Washington Co. of Commonwealth of Va. being at present of sound mind and memory and considering that it is appointed for all men once to die but now knowing the certainty of the time thereof do hereby make this my last will and testament, that is to say first and principally, I recommend my soul to God who gave it and my body to the earth there to be decently buried.

Item-I will and bequeath to my daughter Rosannah Stuart and John Stuart, her husband the plantation we now live on with all the farming utensils thereon such as plows, hoes, axes, adzes, my negro man named Isak, that is to say on the condition that they or either of them so keep my daughter Sarah Beattie and son Francis Beattie during their lives in good warm clothing, victuals & drink sufficient to support them in decency. And to my son, David Beattie and my daughter Mary Beattie, I leave and bequeath to each of them a cow worth three pounds.

I will and bequeath to my daughter Jane Bustard twenty pounds to be paid in horses and cattle by the executors out of my personal estate. And to my daughter Margaret Hansford I will and bequeath twenty pounds to be paid in horses or cattle by the executors out of my personal estate.

And the rest of my personal estate if any, I leave to John and Rosannah - and I do hereby appoint my friends, Matthew Ryburn and James Kincannon executors of this my last will and testament hereby revoking all wills by me before made. In witness hereto I subscribe my name and affix my seal this seventeenth day of Sept. 1789.

There is also record of a lawsuit by "John Beatty's executors vs. Rev. Edward Crawford -- O.S. 53 N.S. 18-Bill 15 Nov 1802" that, according to the book, states that John and Francis Beattie were brothers. This lawsuit was an attempt to regain a portion of land that was given by John to Francis, deed dated 1784, the consideration not given. The suit involved the land willed to John and Rosannah Beattie Stuart above. It is also stated in the lawsuit that John Beattie died two years after Francis Beattie.

"Family" by Robert and Norma Crye, published in "The Beaty Clearinghouse", ed. by Elizabeth Bray Sherrill, CGRS, December, 1989. 2263 Mollys Backbone Road, Sherrills Ford, NC 28673. They say that the father of Francis is: "Probably Francis Beatty of Lancaster Co, PA to Mecklenburg Co, NC" Francis Beatty will in Mecklenburg Co, NC on 29 June 1773, Book G, p 81, probated 9 Sept. 1773. He had children: Thomas, James, Hugh, John Francis, Robert, Wallace, Elizabeth (wife of Robert Gray), Agnes (wife of Robert Armstrong). Cousin James Tate, cousin Thomas Henry mentioned. Executors: Thomas, James, Hugh Beaty, and sons-in-law Robert Gray and Robert Armstrong.
