THE WILL OF ENOCH FENTON March 23, 1789 Book 8, Pgs. 73-74
This indenture made the twenty third day of the third month in the year of our Lord one thousand seven hundred and eighty nine whenceforth that I Enoch Fenton of the County of Frederick in the State of Virginia being weak in body but of a sound and perfect mind and memory do make and publish this my last will and testament in manner and form following that is to say -
First that after my body is decently interred at the discretion of my Executors. That my funeral charges and all my just debts be paid by my sons John & Joseph and my daughter Rebeckah each an equal part thereof.
I give and bequeath to my beloved Wife all my household goods and furniture also cows and the horse called Prince and one room well furnished in the new house which she shall choose and a kitchen also that my son Benjamin shall keep her one cow and one horse wholely for her use and to provide her all her firewood, all which privileges she shall enjoy while she remains my widow - Also I give and bequeath to my Wife the following named Negroes namely Peg Kit Philis Jacob & Johnathan. Also I give and devise to my wife one half of a tract of land lying on the Draine of Isaacs Creek containing seven-hundred and seventy five acres to be divided equal in quantity to and quality to her and assigns for ever-
Also I give and devise to my Wife a small tract of land lying on the hunting ridge joining Isaac Smith, Able Walker and Joshua Woodrow lines in Frederick County aforesaid to her and her assigns for ever.
I give and devise to my son John a part of two tracts of land lying on Babbs Run in the county aforesaid to be divided off in a manner following. Beginning at three pines on the West Side of hunting Ridge corner to Elmores Tract whence a long line west of S 85 W one hundred and Twenty poles crossing Babbs Runn to four marked black oak saplings at the head of a Draine Thence the course continued until it intersects the Western Side Line of the 666 acre Tract and the other side line to begin in another Line of the said Elmores Tract fifteen poles below the last log hollow Thence across the said Runn road to divide the place spring equaly and The course continued likewise it intersects the Western line of 666 acres aforesaid to him and his heirs and assigns forever.
I give and devise to my son Joseph a part of Two Tracts of Land lying on Babbs Runn and hunting Ridge in the county aforesaid to be divided in manner following - Beginning at Maurice Reese second corner thence a straight line to Stephen Onions Line in the middle of Hunters hollow all below the division line be it more as left to him his heirs and assigns for ever.
I give and devise to my daughter Rebeckah all the Land lying between the Sawer Division line of my son John and thereafter line of my son Joseph also half the sawmill standing on said to her her heirs and assigns forever.
I give and devise to my son Benjamin, my Plantation that I live on with the farming utensils Wagon and Smith Tools to him his heirs and assigns for ever.
I give and bequeath to my son Enoch the sum of one hundred Pounds to be paid at the discretions of my Executors only rest less than Ten Pounds for annum to be paid by John Joseph Rebekah and Benjamin equaly.
I give and devise to my Grand Daughter, Sarah Fenton the half of the tract on the Draine of Isaac Creek already mentioned to be divided between her and my wife in quantaty and qualaty as before mentioned to her her heirs and assigns forever.
Lastly I appoint my beloved Wife and my son John Execute this my last will and testament.

CODICIL TO THE WILL OF ENOCH FENTON, January 21, 1805 Book 8, page 75
I Enoch Fenton of the County of Frederick and the State of Virginia do this 21st day of the first month one thousand eight hundred and five make and publish this codicil to my last will and testament in manner following (to wit)
Whereas I in and by my last will and testament did give and bequeath to my beloved Wife five negroes Namely Peg Kit Philis Jacob and Jonathan and since that time I have thought proper to set Kit free Peg and Philis I give to my Wife for her to dispose of them as She shall see cause at her death or any other period.
I also give and bequeath unto her Jacob and Jonathan (mentioned in my last Will and Testament) and also five other Negroes (namely William Tom Best Sam and Henson) To her and at her disposal till they severaly arrive at the age of thirty years and that they with the offspring of the Females, if any there be shall be set free and their freedom legally secured at that age but if my Wife should die before Jacob and William arrive at the age then and in that case I give and bequeath Jacob to my daughter Rebeckah and William to my son John to serve them their heirs and assigns til they arrive at the age aforesaid and lastly it is my desire that this my present codicil be annexed to and made a part of my this my Last Will and Testament being date the twenty third day of the third month 1789 to all intents and purposes in witness where of I have hereunto set my hand and seal the day and year first above written.

At a Court continuance and held for Frederick County the second day of April 1805 this last will and testament of Enoch Fenton deceased was proved by the oaths of Joseph Adams and Mary Adams and the codicil thereunto annexed was proven by7 the oaths of Thomas Barrett & Richard Barrett and ordered to be recorded and on the motion of Hannah Fenton and John Fenton the Executrix and Executor therein named certificate is granted them for obtaining probate whereof and giving bond wherefore they together with Richard Barrett and John Mercer entered into and acknowledged Bond in the penalty of Two thousand Dollars for their due and faithful administration of the said Decedants Estate.

He married HANNAH FENIMORE February 20, 1753 in BURLINGTON CO., NEW JERSEY, daughter of JOHN FENIMORE and SUSAN BRIAN. She was born 1736, and died 1825 in FREDERICK CO., VIRGINIA.

    + 47 i. JOHN4 FENTON, born 1755 in BURLINGTON, BURLINGTON CO., NEW JERSEY; died February 01, 1836 in FREDERICK CO., VIRGINIA.
    + 48 ii. ENOCH (III) FENTON, born Abt. 1760 in FREDERICK CO., VIRGINIA; died July 26, 1839 in STAUNTON, AUGUSTA CO., VIRGINIA.
    49 iii. REBECKAH FENTON, born Abt. 1764; died Aft. 1786.

    Notes for REBECKAH FENTON:
    Rebecca as named in the will of her grandmother, Sarah Brian Fenimore, widow of John Fenimore in 1786. Her mother Hannah was apparently dead at that time. It is believed that she was never married.
