1795 Sep 20 Quitclaim deed - Ebenezer Phillips and Experiance, heirs of the estate of Nathaniel Hendly (Handley/Henle) of Concord to Amos Wood of Concord "for all our rite (sic) and title to our fourth part of said estate in Concord. Wits: Ebenezer Phillips Jr. and Peter Fox. [from the Estate of John C. Friend of Concord / [Concord Antiquarian Society]

In the name of God amen, I Ebenezer Phillips of Boxborough in the County of Middlesex and Commonwealth of Massachusetts, yeoman and through the goodness of divine Providence I enjoy Bodily health and am of sound mind and memory yet considering the uncertainty of the human Life I do make and ordain this my Last will and Testament.

In the first place I Commit my spirit to god who gave it hoping through the merit of the the great Redeemer to find acceptance with him is to the worldly estate god has given me after all my just debts and funeral charges are paid by my Executor here after name I dispose in the following manner, namely:

Imprimis

I give and bequeath to my son Ebenezer Phillips the sum of one dollar with what I have already given him is his full proportion of my Estate.

I give and devise to my daughter Ruth Forster my house and Barn and all the right and title I have in a peace of land with all my priviledges there unto belonging bounded as follows: begining at the road by Land of Augustus Walker (difficult to read) ...bounding in said Walker's Land ...to the wall now stand by the swamp... reserving a right in my house for daughter Lidia as long as she remains single with the use of the well water.

I give to my son Stephen the sum of thirty dollars together with all my wearing apparel that may be left at my decease

I give to my Daughter Lydia my bed and beding to her and her heirs forever.

I give to my granddaugthers Hannah, Betsey and Mary Pool the sum of thirty dollars to be paid by my Executor in one year after my decease.

My will is and I do herby give and devise unto my children hereafter named Stephen Unis Anna Abigail Hepsabeth and Lydia all and every part of the reside of my Estate both real and personal to be equally divided between them and their heirs for ever.

Further as I consider the law of this Commonwealth makes provision for my widow she having a right to the improvement of one third of all my real and personal estate during her life I have therefore not mentioned any provision for her support in this Last will and Testament.

Finally I do Constitute and appoint Isaac Patch of Littleton in the County and Commonwealth aforesaid, yeoman, my sole Executor to this my last will and Testament directting and appointing him to pay above named Legetees ouf of my Estate as is expressed in my Last will and Testament.

I now revoke disannull and make void all former wills and Testament, allowing, this and no other to be my Last will and Testament.

In witness whereof I the said Ebenezer Phllips have Set my hand and seal this twenty sixth day of August in the year our Lord one thousand eight hundred and five signed sealed delivered and pronounced by the said Ebenezer Phillips to be his last will and Testament.

Will of Ebenezer Phillips of Boxborough, Middlesex, Yeoman decased being brought to court 1 Oct 1811 - John Heartwell and William Taylor wits. naming Nathaniel Cobleigh as another witness but "now absent"

Administration of the estate granted to Moses Whitcomb instead of the executor who "has absconded" - Augustus Tower was his security and when he filed papers Abel Hill and James Winthrop and Abijah Warren were wits.

Ephraim Whitcomb, Gentleman and Ephraim Whitcomb Jr., gentleman, both of Boxborough and Martin Wood of Littleton, yeoman inventoried the estate - $49.66 for personal estate - $525.00 real estate

Moses Whitcomb returned added papers with Moses Whitcomb Wits Augustus Walker & Oliver T. Davis

The estate was quite small and after expenses not much was left aside from court costs taxes, etc. the estate owed

16.03 to Evi Rogers 1.00 to John Hartwell 1.00 to Ephraim Whitcomb 1.86 to Ephraim Whitcomb 1.00 to William Taylor 1.00 to Martin Wood 2.00 to Samuel Farnsworth 33.77 to Isaac Patch 2.50 paid to John Parker for the grave 2.50 to John Blanchard for the coffin

by the time they were done the estate was 4.55 in the red

John Forster of Boxborough, yeoman and Ruth his wife in her right being a principal devisee of the said Will, the executor having absconded, ordered to serve the other heirs of the estate within 20 miles of the said court within 14 days and advertise in the Columbian Centinel (?) printed in Boston by William Burdick

To be sold at Public vendue on monday the 12 Dec next at two o'clock in the after noon at the house of John Foster in Boxborough a small farm consisting of mowing tillage and pasture land with an orchard and dwelling house on the same formerly the estate of Ebenezer Phillips late of Boxborough deceased by order of the Supreme court holden at Cambridge on the last Tuesday of October 1811, Moses Whitcomb, admor. 4 Nov 1814
