Will

Will of Ebenezer Morrow

I Ebenezer Morrow, of the County of Buncombe, State of North Carolina declare this to be my last Will and Testament, hereby revoking all former wills by me made.

1. I hereby appoint Wm. H. Hurst executor of this will.

2. I desire that as soon after my decease as practicable my said executors shall convert all my property of every description into money, and to this end , I direct that they sell my real estate and personal property, debt excepted, on such terms and in such manner as they may think best, and that they collect all my debts, except those due me at my death from my children and grandchildren which I bequest to them in addition to the legacies and bequests hereinafter made: And as my said property shall be converted to money as a foresaid, I desire that it shall be applied pro rata in payment of the bequests hereinafter made.

3. I give and bequeath to my grandson Benjamin Morrow, son of my deceased son John N. Morrow.

4. I give and bequeath to my grandson William Vanhook, so of my deceased daughter Susan Vanhook, the sum of one hundred dollars.

5. I give and bequeath to my daughter Jude Ann K. Hurst wife of William H. Hurst, one fifth part of my estate after deducting the bequests named in items 3 and 4 of this will.

6. I give and bequeath to H. K. Rhea one fifth part of my estate after deducting the bequests named in items 3 and 4 of this will, in trust for the benefit of my daughter Isabella Foster, wife of Wm Foster, to be paid to her as follows: during her coverture he shall pay her only such amounts from time to time as her necessities may require, and he shall be the judge as to the amount she may actually need. If she survives her present husband, she shall be entitled at this to demand the balance that may be due her of the said one fifth part of my estate, but if she does not survive her present husband, it is my will that H.K. Rhea shall pay the residue of the said one fifth of the estate then in his hands to the children of my said daughter Isabella.

7. It is my will that my grandchildren Simon, William, John and James Morrow, children of my son Samuel C. Morrow deceased, three(?) of the children of my deceased daughter Susan Vanhook, ?towit? , Sarah Parish, wife of Nathaniel Parish, Susan Myers wife of John Myers, and Isabella Watson, wife of Henry Watson; and Alice Ford, wife of Landon(?) Ford, the sald Alice being the daughter of my deceased son John W. Morrow shall each receive an equal part of my estate, and I do hereby devise and bequeath to each of said grandchildren on twentieth part of all my estate after deducting the first two bequests in the will made.

8. My daugher Sarah E. was married several years since to William Robertson and has not since been heard from. It is my will that my said xecutors shall retain one fifth part of all my estate, first deducting the two first bequests made in this will, for th period of five years, upon the following trusts, to wit, If my said daugher Sarah E. Robertson shall within that time make application for said one fifth part so to be retained by them they shall pay the same to her. If she be dead and her children apply for the same within that time it shall be paid to them unless htere be not as many as for of them; in which case I desire that they shall each receive a sum equal to one twentieth of my whole estate,...
