Charles Hays' land (Borden Tract, NW, 165 acres (1766) & 189 acres (1742), adjoining and nearby 200 acres (1766), as shown on the map meticulously drawn by J.R. Hildebrand, cartographer. Note that the 1765 and 1770 transactions, listed above, establish that in October, 1765, Charles was married to Barbara, and by June, 1770, he had married his second wife, Margaret.

Well, I haven't looked at my Hays stuff in a while (and I'm not real organized) but I'll tell you some of it. I got interested in a Jacob Hays that had some business dealings with my gggrandfather Charles B.S. Hays in Morgan County, Ala about 1830. I have yet to prove a relationship between them but I had hit a dead end with Charles B.S. Jacob Hays was supposed to be from TN and moved down into MOrgan co and left before 1830 by family tradition. So then I started searching all of TN for Jacob. I found him in Lincoln Co in 1830 and traced him pretty well the rest of his life and found he died in Obion Co. Tn. Then I got his War of 1812 Pension record that gave me more clues about his earlier life and I found that he was listed as owning land in 1809 in Greene co TN. (I'm fairly certain this is the same guy, there weren't that many Jacob's in TN at that time that could be the right age.) Eventually I went to Nashville to see if I could find anymore clues about he and the land and was lucky enough to find the land deed tied up in the estate settlement of Charles Hays who died in Greene Co about 1799 without a will. Fortunately for people trying to trace his descendents there were numerous court records among his children trying to settle things. The one that proved to me that Jacob was his son was recorded May 1822. It is Robt and Jacob Hays (brothers) vs. Michael Bright, Joseph Hays, and Henderson Walker. 200 acres is in question and states in it that "Charles Hays, the father of the complainant, Robert and Jacob and of the defendent Joseph....." Margaret Hays is listed as the administratrix of Charles's estate in TN and it says she is his wife. She is listed on the land deeds in 1800 but disappears about 1809 so I suppose she is dead then.

Then in Rockbridge Co Va Deed Bk A, p. 53 6 Oct 1778 between Charles and Margaret of the Co of Rockbridge " sell to John Walker 404 acres comprised of 3 small tracts......and 50 acres willed to him by his father John Hays......

I'm satisfied that the Charles in Greene Co is the same Charles who left Rockbridge co and is the son of John (who came from Ireland before 1740 with his family). I suppose you know all about that. Charles has a wife in Va named Margaret and one in Greene Co named Margaret. Also there is a Greene Co Heritage book that gives a history of the Hays family and says this Charles is the son of John in Va and was married to a Margaret.

I lived in TN for almost 10 years and really worked on the Hays family. My husband was transferred to Richland WA almost a year ago and I haven't done much since we've been here. I was a Hays before I married. My Hayses were in MS by 1840 or 50 and before that in Ala. I would love to definetely connect my gggrandfather Charles with the Hayses of TN and Va but can't but I do think that because I have found deeds between Jacob and my Charles they had to be some kin. I found out from another Hays researcher that Jacob was supposed to have come to Morgan Co from TN with his neice and nephew Miles and Lucinda Hays plus their mother. (She must have been widowed.) They stayed but Jacob left and "went back to whereever he came from" and didn't stay in Ala very long. My Charles lived near Miles and Lucinda and was born about 1800 and was only 5 or 6 years older than they were.

Hope this helps. How do you fit in with the Hayses? When I lived in TN I visited the Hays land in Greene co and also the site of the Hays farm that John Hays and Charles and brothers Andrew and John Jr. settled on about 1740 in VA. Both places are bueatiful and the one in Va is still a working farm. Do you know anything about them in Ireland? No doubt they came from northern Ireland. They were supposed to come thru the port of Philadelphia and several other families who settled in the same area in VA were supposed to be from northern Ireland. maybe they came together. Let me know if you can fill in any of the blanks for me.

Yes, these are 2 different Charles Hayses. Several years ago I decided these had to be too different people since they died in different years with different wives. the one I'm talking about died without a will between 1797 and 1799. There are many records (Chancery Ct Records, Ct of Common Pleas, Deeds) in Greene Co about his children fighting over his estate. The children are Robt, David, Margaret, Joseph, Jacob, and Rebecca that I know of that lived in Greene Co. Tn. Robt and David are buried in Greene Co., Margaret married Nathaniel Ledgerwood and moved to Indiana.

In chalkley's there is a part of a deed (IXX, p. 145) that says charles Hays, SR. and Margaret to Charles Hays, Jr. 10 acres devised to him by his father John Hays, by will dated 5th Dec 1750. I'm assuming this is the same Charles and Margaret in Greene Co TN. There is a Greene Co Heritage Book that this Hays family is also written up in. These Hayses are really confusing. I was just wondering if you could fit Charles Hay and Rebecca in with the people in Rockbridge. would he be the right age to be Charles Hays, Jr.? Good luck with your searching. Diana

1740 The first mill ...was that of Charles Hays. It was probably not built later than 1740. [HRCV,40] The gristmill came early and has been well represented ever since. The first in the county was that of John Hays It was built around 1740, and must have been specimen of the primitive affair known as the tubmill. But Hays had a fulling mill by 1751, and probably earlier. [hrcv,169]
