Ordered that Susanna Brazier serve Archibald Kyle, her Master, twelve months over & above the term of her present indenture for having a bastard child. (Note: this appears to be the same Susanna Brazier that later murdered Archibald's wife, Margaret, see record below).

Dougherty, George Dougherty and John Larkin, who retd. a verdt. in favor of the plff., awarding him one penny damages & costs.

• At a court held for Botetourt County October 1774. At a court held at Botetourt Courthouse on Tuesday the 4th of October for the trial of Susanna Brusine, a colored servant woman, the property of Archibald Kyle, on suspicion of her feloniously murdering Margaret Kyle, the wife of Archibald Kyle.

Present: James Trimble, Geo. Skillern, Wm. McClenachan and Adam Smyth, Gentlemen.

The said Susanna being brought to the bar and arraigned of the felony aforesaid, pleaded thereto not guilty, whereupon sundry witnesses were sworn and examined touching the said felony and the prisoner heard in her defence. On consideration whereof the court are of opinion that she is guilty thereof and that she ought to be tried for the same in the General Court, and is removed to goal. James Cuncy, John Jackson and Samuel Adams severally came into court and acknowledged themselves indebted to our Sovereign Lord the King, his heirs and successors, in the sum of one hundred pounds each of their respective goods, and chattels, lands, and tenements to be levied and to our said Lord the King rendered. But upon this condition: that if they should make their personal appearance in the Capitol in the City of Williamsburg on the sixth day of the next court to give evidence against said prisoner and then not depart from there without leaving said court, then this obligation to be void.

• At a court held for Botetourt County the 11th of August, 1778. The Commonwealth against George Lefener for a breach of the peace, parties heard. It is ord. that the said Lefener be bound in twenty pounds and two securities in ten pounds each that he shall be of good behaviour to all the subjects of this Commonwealth for and during the term & time of twelve months from this day. Whereupon the said George together with James Norvill ahd Archibald Kyle, his securities, came into court and acknd. themselves, the sd. George in twenty pounds and his said securities in ten pounds each of their respective goods & chattels, lands & tenements to be levied, with condition that the sd. George shall be of good behaviour the term &c.

This day came the parties &c. & also a jury, towit: Samuel Walker, Junr., Archibald Kyle, Richard Thomas, Andrew Armstrong, Geo. Davidson, Jesse Clark, John Jameson, Wm. Galloway, Nicholas Carper, John Ross, Samuel Kinnerly, and John Davies, By consent of the parties and with the assent of the court, the jurors were withdrawn and discharged from rendering the verdict, and the same was continued.

First Wife's Apparent Murder

The following court record in Botetourt County Court appears to indicate that this Archibald Kyle had a prior marriage to wife Margaret that appears to have been murdered by a slave:

HOMICIDE: Susanna Brusine (a colored servant woman, property of Archibald Kyle) murdered Margaret Kyle (wife of Archibald Kyle).

Court proceedings: SE 10/4/1774 EXAM COURT: FELONY: HOM: Susanna Brusine, a colored servant woman, property of Archibald Kyle, on suspicion of her feloniously murdering Margaret Kyle, the wife of Archibald Kyle. pNG. Witnesses examined. fG. "and that she would to be tried for the same in the General Court." James Curray [Cuncy in Summers, Annals], John Jackson, & Samuel Adams post 100 l. bonds to appear as witnesses. [Appears from this record that she was a free woman of color who was indentured to AK. This is the only entry on her in the index.]

Notes

Archibald Kyle is a suspected sibling (or possibly a cousin) of Margaret Kyle who married James Rowland. Additional research/sources needed to prove.

I have a Archibald Kyle in Botetourt County, Va.in 1763 & died in 1783 or 1784. Wife was Mary & children were Sally, Rhoda, Fanny & Marvin. Marvin later moved to Ala. I suspect that Archibald was from Pa. prior to moving to Va.
