DEED: VA; Botetourt Co.; Deed Book 3, p. 5, 27 Jun 1780.

This Indenture made the twenty seventh of June in the year of our lord one thousand seven hundred and eighty between William Hamilton of the one parrt and Andrew Kincaide of the other part witnesseth that for and in consideration of the sum of four hundred pounds current money of Virginia to the said Wm Hamilton in hand paid by Andrew Kincade at or before the sealing and delivery of these presents the receipt whereof he doth hereby acknowledge [next follows acknowledgement of the above lease and a release, discription of the land (same as above) and the same conveyence discription] unto the said Andrew Kincade his heirs and assignees forever to the only proper use & behoof him the said Andrew Kincade and of his heirs or assignees forever and the said William Hamilton doath for himself his heirs exec and administrators doth covenant and promise and grant to and with the said Andrew Kincaide his heirs and assignees by these presents that are seized of a good share perfect and indefesible Estate of Inheritance in fee simple of and in the premises hereby granted and released and that he hath good power and lawfull and absolute athority to grant and convey the same to the said Andrew Kincade and that the said premises now are and so fore ever heeafter shall remain and be free and clear of and from all other former and other gifts grants bargains sales dower right and right of dower judgements executions titles troubles changes and incumbrances whatsoever made ? commited or suffered by the said William Hamilton or any other person or persons what so ever [this continues in the same way for another paragraph] And lastly that the said Wm Hamilton and his heirs all and singular the premises hereby granted and released with the sertenaces unto said Andrew Kincade his heirs and assignees against him the said Wm Hamilton and their heirss and all and every other person and persons whatsoever shall warrant and forever defend by these presents. This Indenture made this sevent Day of June one thousand seven hundred and eighty five betwen Andrew Kincade & Mary his wife of the county of Botetourt of the one Part and William Kincade of said County of the other Part witnesseth that the said Andrew Kincade for and in Consideration of the sum of two hundred Pounds current Money of Virginia to him in hand paid by the said William Kincade the receipt where of he doth hereby acknowledge and doth thereof acquit and discharge the said Wm Kincade his heirs exec & Admin. he the said Andrew Kincade & Mary his wife hath granted bargained and sold and by these pressents doth grant, bargain, sell allien? ? and confirm unto the said Wm Kincade his heirs and assignes forever one certain tract or Parcel of land containing one hundred and ten acres lying & being in Botetourt County on Jackson River (formerly Augusta) and bounded as followeth to witt- Begining at two black Oaks on a hill ? thence west sixty four poles to a white oak north sixty five degrees west twenty six poles to a spanish oak and white oak on the River Banks thence up the severall courses of the River two hundred and fourteen poles to two Black oaks on the bank of the river thence east one hundred and fifteen poles to a line on a hill upon the old line thence with said line south seven degrees west one hundered and seventy six poles to the begining. To have and to hold the said bargained tract or parcel of land with all wooods, under woods, swamps, marches, low grounds, meadows, fieldings and his due shares of all veins mines & quarries as well discovered as not discovered within the bounds afforesaid with all proffits and comodities thereunto belonging or in any wise assurtaining to the said Wm Kincade his heirs and assignes forever, and he the said Andrew Kincade and Mary his wife for themselves and their heirs doth covenat grant and agree to with the said Wm Kincade that he the said Andrew Kincade & Mary his wife the said land and premises with every of the assertenancies unto the said Wm Kincade his heirs and assignes shall and will for ever warrant and difffend in witness whereof he the said Andrew Kincade and Mary his wife hath hereunto set their hands and seals the year and day afore written.

Will of Andrew Kincaid

Will of Andrew Kincaid, dated 9 June 1810

I Andrew Kincaid of the County of Greenbrier do hereby make my last will and testament in manner and form following, that is to say:

1st I desire that all my Debts and funeral expences be first paid out of my personal Estate.

2dly after the payment of my Debts and funeral expeces, I give to my wife Mary Kincaid one third part of my Estate both Real and personal, for and during the term of her Natural life, and after her decease, I give the same to my son andrew Kincaid to be enjoyed by him forever.

3dly, I give to my Son's John Kincaid, Robert Kincaid, James Kincaid and Thomas Kincaid one Dollar and twenty Cents each to be injoned by them forever. Also, I give to my Deaughters Sarah Caldwell, Elizabeth Miller, Ann Garten, Mary Wyatt and Margret Slone one Dollar twenty five cents each to be enjoyed by them forever.

4dly, I give all the Remainder of my personal Estate goods and Chattels, and the land I now live on to my Son Andrew Kincaid to be injoyed by his his heirs and assigns forever.

And lastly I do hereby Constistute and appoint my Sons Robert Kincaid and Andrew Kincaid Executors of my last will and testament, hereby Revoking all other or former wills or testaments, by me heretofore made.

In witness where of I have hereinto Set my hand and affixed my Seal this ninth Day of June 1810

The last Testament of Andrew Kincaid dec.d was presented in Court & proved by the Oaths of James Thompson & Mathew Kincaid witnesses thereto and the same is Andres to be Recorded And on the motion of Andrew Kincaid one of the Executors therein named who made Oath according to Law and thereupon he entered into Bond with James Thompson & Mathew Kincaid his Securities in the penalty of One Thousand dollars conditioned as the Law directs Certificate is granted him for obtaining a probat of the said Will in due form. Liberty being reserved to the other Executor named in said Will to join in the Probat when he shall this fit.
