James Hiten & wife

    To

Robert Madison

This indenture made this 19th day of August in the year of our Lord one thousand eight hundred and 41 between James Hiten and Nancy his wife late Nancy Pock of the County of Harrison and Commonwealth of Kentucky of the one part and Robert Madison of the County and Commonwealth aforesaid of the other part. Witnesseth that the said James Hiten and Nancy his wife late Nancy Pock for and in consideration of the sum of one hundred and seventy five Dollars current money of Kentuck[y] to them in hand the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grant bargain sell and confirm unto the said Robert Madison his heirs and assigns all that tract or parcel of land situated and being in the County of Harrison on the waters of Mill Creek containing 24 acres 3 Roods [sic] and 10 poles and bounded as follows viz: Beginning at fig. 2 [NOTE: Diagram is not reproduced in the Clerk's copy] then S. 49 W 31 poles to figure 3 a sugartree & white oak then N 35 W 127 poles to fig. 4 a Dogwood & ash then N 57 1/4 E 31 poles to fig. 1 corner to lot No. 1 thence with Lot No. 1 to the Beginning containing as above named 24 acres 3 Roods and 16 poles being Lot No. 2 as laid off & referred to in the division made among the heirs of Jno. V. Pock decd. together with all and singular the premises thereto belonging or in any way appertaining to have and to hold the land hereby conveyed with the appurtenances unto the said Robert madison and his heirs and assigns forever and the said James Hiten and wife for themselves and heirs executors and administrators the aforesaid tract of land and premises unto the said Robert Madison and his heirs and assigns against the claim or claims of all and every person or persons whatsoever doth and will forever defend by these presents. In witness whereof the said James Hiten and Nancy his wife late Nancy Pock have hereunto set their hands and seals the day and date written.

State of Kentucky Harrison County Sct.

I Thomas B. Woodyard Cler of the County Court for the County aforesaid do Certify that this deed from James Hiten and Nancy Hiten his wife to Robert Madison was produced to me in my office on the 10th day of September 1841 and was acknowledged by said James Hiten to be his act and deed and the said Nancy Hiten his wife being examined by me privily and apart from her husband declared she did freely and willingly seal and deliver said writing and wishes not to retract it and acknowledged said writing again shown and Explained to her to be her act and Deed and consenteth that the same might be recorded. Which is done this 22nd day of September 1841.
