1. John Finley ref: 64, m. (1) Bef 1740, in VA, _____ Thomson, d. Bef 1750, Augusta Co., VA, m. (2) Bef 1750, in VA, Mary Caldwell, b. 1728, Lancaster Co(?), PA, (daughter of T. Caldwell and Mary J. Parks) ref: 65, d. Abt 1787, Montgomery Co(?), VA. John died Bef 19 AUG 1782, Montgomery Co, VA. !Parentage speculative ... not in agreement with Stout. Married, 1st, a daughter of Rev. John Thomson (about 1740-1748); married, 2nd, Mary Caldwell (prior to 1750). Purchased the John Robinson property on South River of the Shenandoah in 1746 (Augusta Co. DB 1:77). Sold 2/3 to William and Robert Finley in 1750 (Augusta Co. DB 2:207-713). Sold remaining 297 acres in 1765 (DB 11:808). Bought 400 acres in Prince Edward Co. three months later (Prince Edward Co. DB 3:1). Sold that in 1773 (Prince Edward DB 5:63) and bought 327 acres on Sally Run, Branch of Reed Creek, in Montgomery County from John McFarland (Montgomery County Order Book 1:142). Deeded this property to sons, David and Samuel in 1779 in exchange for life care (Montgomery County DB A:283, A:258). Deposition ordered for Mary Finley, August Court 1782; done by William Davis, William Doak, William Ward on 2 September 1782. Died prior to 19 August 1782 when heirs gave legal notice (Montgomery Co. DB A:284).

!It was this John Finley who was instrumental in establishing Tinkling Spring Presbyterian Church near Staunton (Fisherville). One of five commissioners appointed to attend to the business affairs of the church in 1741. Served as an elder from about 1743 to 1763 (Wilson's "Tinkling Spring," p. 85, 431). Established a mill, authorized payment in financing the first church building; head of one of three congregational districts organized to support the Church (Wilson, p. 25, 72, 91). Justice of Peace in Orange County before 1745; same in Augusta after 1745 (Wilson, p. 109-109). Wilson believes he may have transferred his efforts to Brown's Meeting House (p. 166). However, this is more likely the contemporary John Finley who lived on Middle River.

!Bottom line. Do not confuse this John Finley with the John Finley who lived on Middle River and whose wife was Thankful Doak. They are two separate, contempory persons, not father and son.

_____: !Daughter of Rev. John Thomson and mother of Elizabeth Finley, who married James Gillespy. Note written by Rev. Richard Sankey in Prince Edward County on 4 Jan. 1764 identifies Elizabeth as his wife's niece. Sankey's wife was Sarah Thomson, daughter of Rev. Thomson. See J.G. Herndon, "Some of the Descendants of the Rev. John Thomson (1690-1753)," VA Magazine of History & Biography, LI (1943): 394-404; Genealogies of VA Families (5 vols. Baltimore: Genealogical Publishing, 1981) 5:454-464. Marriage bond, 5 January 1764 shows Elizabeth's father, John Finley, Sr. "with his consent,"; uncle by marriage, Robert Baker surety; consent witnessed by Baker and John Finley, Jr. (Prince Edward Co., VA, Marriage Bonds, 1754-1850, LDS film #0033254).

Mary: !"Your grandfather was David Finley and he married Elizabeth Mounts; his father was John Finley who married Mary Caldwell a cousin of Martha Caldwell, who was the mother of the famous statesman John C. Calhoun." Genealogy & History, Washington, D.C., 15 Dec. 1943. (Reportedly from bible of Jane Ann Finley, eldest daughter of David and Mary).

!Jim Finley gives info that Mary was born 1724 in Ireland ... may well be true, proof awaits.

Children by _____ Thomson:

+ 2. i John Finley b. Bef 1740.

+ 3. ii Elisabeth Finley.

+ 4. iii William Finley.

5. iv James Finley d. Bef 26 MAR 1749, Augusta Co., VA. !Christened at Tinkling Spring. Most likely died young as a second James was born 26 March 1749 (Wilson, p. 474).

+ 6. v George Finley b. 2 Jan 1743.

7. vi James Finley. !There were 2 or 3 James Finleys living in Montgomery/Wythe County, VA dating from 1773 when John and Mary (Caldwell) moved there. They show up in the Order Books as well as in deeds and surveys and are variously referred to as James, Sr.; James, Jr.; and Capt. James. A James Finley, Sr. left a will dated 23 July 1799, proved 10 August 1802 and named James, his only son. He also named William Finley, beloved grandson (Wythe County WB 1:220). There was also a Captain James Finley who left a will dated 15 October 1800, proved 15 April 1801. He named a son, William and a nephew, Jonathan Henderson (Wythe County WB 1:176). How these James' relate to this family is unknown at this time.

Children by Mary Caldwell:

9. viii Samuel Finley b. Augusta Co., VA. !Probably born on 297 acre property bought by father in 1746, in Beverly Manor, Augusta Co., VA. (See notes on brother, David). In Jehu Stevens Company, Montgomery Co., VA Militia in late 1770's. Moved to KY with brother, David, about 1781. Tax records of Mercer Co., KY, show Samuel living with David and Isaac (son of brother, George?). A Samuel Finley was ordained, 1 March 1796, in Madison Co., VA (B:356). Could this be the same Samuel?

+ 10. ix Thomas Finley b. 11 Feb 1757.

Second Generation

2. John Finley (1.John1) b. Bef 1740, Augusta Co., VA(?), m. in Augusta Co., VA(?), Sarah Steele. John died Bef 28 DEC 1807, Augusta Co., VA. !Witnessed marriage bond of sister Elizabeth to James Gillespy, 5 January 1764, in Prince Edward County, VA (Prince Edward Co., VA, Marriage Bonds, 1754-1850, LDS film #0033254). Purchased 100 acres in Beverley Manor, 18 August 1773, from James and Elizabeth Gillespy (Augusta Co., DB 19:414). Gave Power of Attorney to William Finley of Wythe County, 24 January 1792 (Wythe County, DB 1:82); deeded 327 acres on Reed Creek to David and Samuel Finley of Lincoln County, KY, 12 June 1792 (Wythe County DB 1:84). Wrote will 6 July 1807 (Augusta Co., DB 10:172); probated 28 December 1807. Left land on Elkhorn, Green and Dicks River, KY to heirs ... Sons John, William and Samuel; daughters Sally, Peggy Huchison, Jinney Fraser. Also mentioned Peggy Mooney in his will. His son, William, later mentions Francis Marion Finley, son of Margaret Mooney in his will of 21 February 1836 (Augusta County WB 21:291).

!"About 1796 John [Hutchinson] and his wife moved from Virginia to Bourbon County, Kentucky near Paris. They were accompanied by William Frazier and his wife Jean Finley, a sister of Margaret. Both families resided on farms in Bourbon County, Ky. until 1806 when, because they were opposed to slavery, they removed to Greene County, Ohio." From Milford E. Barnes and Andrew Wallace Barnes, "John and Margaret (Finley) Hutchison and Their Descendants." Iowa City: 1965, p. 49.

!A copy of his will was sent to Scott County, KY, 15 September 1810 and was acknowledged in Scott County 1839 saying the original will of record was destroyed, but certified copy examined and ordered recorded (Scott County WB G:70-71). This occurred during the time the estate of John T. Finley was being settled in Scott County ... lending credence to the fact that John and Samuel Finley in Scott County were, in fact, this John's sons.

Sarah: !Named in will of father, Samuel Steel, 16 August 1789 (Chalkley, III:202).

Children:

+ 11. i Samuel Steele Finley b. 1769.

+ 12. ii Margaret (Peggy) Finley b. Abt 1770.

+ 13. iii John S or T Finley.

14. iv Sarah (Sally) Finley b. Abt 1773, P.E./Augusta Co?, VA, d. 17 Apr 1851, Augusta Co., VA, buried: Tinkling Spring, Augusta Co, VA. !Inherited land on Dick River, KY from father in 1807 (Augusta County WB 10:172). Birth and death dates from Wilson's "Tinkling Spring." p. 462

15. v William Finley b. Abt 1780, Augusta Co., VA, d. 28 Nov 1836, Augusta Co., VA. !Inherited land on Green River, KY from father in 1807 (Augusta County WB 10:172). Vital data from Wilson's "Tinkling Spring," p. 462.

16. vi Jane Jean (Jinney) Finley m. 1 Apr 1794, in Augusta Co., VA, William Frazier. !Inherited lot in Waynesboro from father in 1807 (Augusta County WB 10:172). Marriage from Chalkley II:310; Saml. Finley, surety; [most likely her brother]. The Fraziers moved to Bourbon County, KY about 1796, near Paris. In 1806, they moved on to Greene County, OH because they were opposed to slavery (from Barnes and Barnes - see record of sister, Margaret Hutchison).

William: !Marriage license found in Chalkley II:310; also in Cecil McDonald, "Some Virginia Marriages, 1700-1799." 1972.

3. Elisabeth Finley (1.John1) m. Abt 5 JAN 1764, in Prince Edward CO, VA, James Gillespy, b. Abt 1730, Ulster, N. Ireland, d. 1792, Blount Co, TN. !Was living in Prince Edward County with her aunt and uncle, the Rev. Richard Sankeys, in 1764 when she married James Gillespie of Augusta County. This positively identifies her as a granddaughter of the Rev. John Thomson, through the John Finley who married a daughter of Thomson (J.G. Herndon, "Some of the Descendants of the Rev. John Thomson," Virginia Magazine of History and Biography, vol. 51, 1943, p. 394-404). She and her husband lived on the old Gillespie property on South River until 1787 when they sold their 300 acres on South River to Michael Coyner of Cumberland County, PA (DB 26:37). In March 1794, John Finley, in a suit with Matthew Gleaves stated he would obtain a deposition from James Gilaspy of Little River, waters of Holestine in New Territory (Augusta County, drawer 449).

!Names of children obtained from Lillian Gillespie, 1821 Institute Drive, Longview, TX 75602 (903/753-3715), by phone 2/6/93.

James: !Importation given in Wilson ("Tinkling Spring," p. 426) on 24 July 1740, with James Gilasby, Jennet, Agnes, John, James and William Gilasby; O. Bk II, 208. His father, James, Sr. was an elder at Tinkling Spring (Wilson, p. 86). James, Jr. married Elizabeth Finley, daughter of John Finley, Sr. and ..... Thompson (daughter of Rev. John Thomson); date of marriage bond 5 January 1764, in Prince Edward County (Prince Edward Co., VA Marriage Bonds, 1754-1850, LDS film #0033254); her uncle by marriage, Robert Baker was surety, consent witnessed by Baker and John Finley, Jr. Gillespie's property was near Robinson property in Beverley Manor on South River (Hildebrand map). James and Elizabeth Gillespy sold 100 acres adjoining them in Beverly Manor to John Finley on 18 August 1773 (Augusta Co., DB 19:414). Probably her brother, John, Jr. who witnessed consent of their marriage. James and Elizabeth sold 300 acres on South River, where they lived, to Michael Coyner of Cumberland County, PA; neighbors included David Vance, McClure, Jno Finley, George Coyner (Augusta County DB 26:37); dated 22 August 1787. On 14 June 1793, John Findley, wheelright, stated his intent to obtain a deposition from James Gilesbpy (regarding suit brought by Matthew Gleaves), at his house on Little River, waters of Holstein in the New Territory (Augusta County Drawer 449, document dated 1794).

!Lived in Rockford, Blount County; killed by Cherokees in 1792

!According to Dorothy D. Gillespie, 717 West Highland Avenue, Malvern, AR 72104, James, along with brothers John and William, went to a sparsely settled wilderness of the Indian Territory of North Carolina/State of Franklin in 1787. The State of Franklin existed from 1784 to 1788. It was originally North Carolina territory ceded to the United States to satisfy a debt. This area later became the Tennessee Counties of Caswell, Sevier and Blount (Elholm District of State of Franklin South of the French Broad in Indian Territory). Brother, William, settled on the South side of the Holston River a few miles below where Little River joined the Holston, now in Blount County at the Holston College Cemetery - Louisville. James and John settled a few miles to the north. After 1788, William's land was in Greene County, NC. After June 1792 William's land was in Knox County. After 1795 it was in Blount County (Holston River was dividing line between Blount and Knox). The Holston in this area became the Tennessee River in the mid 1800's. The area which was Greene County, NC went to Tennessee in 1806.

Wilson in "Tinkling Springs," gives 30 January 1743 as birth date of this William Finley. Stout has fused him incorrectly with family of John and Thankful (Doak) Finley. Notes for MARY CALDWELL: Some sources claim that Mary Caldwell's father was Thomas, others claim it may be a John Caldwell from Augusta County, VA

From: finleyc@sonoma.edu Subject: Caldwell of Vaughn's Creek, Prince Edward County, VA Date: Tue, 19 Apr 2005 19:31:31 -0700 (PDT)

Is anyone on this list interested in the Caldwells who lived on Vaughn?s Creek in Prince Edward County, Virginia in the mid- to late- 1700s? I am searching for a connection between them and John Finley, who lived in Augusta County from the late 1730s until about 1765, when he moved to Prince Edward County.

I have done extensive research on this John Finley and he was married first to ____ Thomson, daughter of Rev. John Thomson; they had at least six children. John married a second time Mary (presumably Caldwell) before 1750, and they had at least three children. John and Mary Finley moved to Prince Edward County and bought property on Vaughn?s Creek from Jacob Garrett 15 June 1765. His son, William, also bought property near Vaughn?s Creek from a John Caldwell on 19 August 1765. Another son, George, was given 200 acres on branches of Vaughn?s Creek by his father-in-law, Thomas Fulton, on 28 April 1769. Coincidentally, a John Caldwell, who had been living on Vaughn?s Creek in Prince Edward County went to live with his son, David, in 1766. David also lived on Vaughn?s Creek. This is documented in a lengthy Augusta County Chancery case, Watson vs. Caldwell, that spanned the years 1785 to 1804. On 25 March 1796 David Caldwell stated that his father lived with him from about 1766 until his death about August 1789, at the age of 94 year 6 months. The elder John Caldwell?s birth year is, therefore, estimated as 1695.

Is this elder John Caldwell the father of Mary who married John Finley?
